HomeMy WebLinkAboutRes1989-150 . . . sponsored by: Schaefermever CITY OF SEWARD, ALASKA RESOLUTION NO. 89-l50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, URGING THE LEGISLATURE TO ADOPT SENATE BILL 229, AN ACT RELATING TO GOVERNMENT LIABILITY FOR DAMAGE OR INJURY RESULTING FROM HAZARDOUS RECREATIONAL ACTIVITIES WHEREAS, the City of Seward urges the State to exercise its responsibility to provide a broad spectrum of recreation oppor- tunities for all Alaskans; and WHEREAS, certain common recreational activities have an inherent risk of injury which under current state statutes limits the State and its local governments in their ability to provide recreational opportunity to its citizens; and WHEREAS, municipalities are having recreational services because liability unavailable or too expensive; and to reduce or close insurance is either WHEREAS, voluntary organizations help provide communities with a broad spectrum of recreational activities not being offered by the public sector and establishing a cooperative relationship under the local government would enable them to provide programs they might not otherwise be able to provide; and WHEREAS, the President's commission on American Outdoors has recommended that the standard of care for which an organization or government should be responsible in providing recreational opportunity be shifted from "mere negligence" to "gross neg- ligence". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City of Seward urges the Alaska State LegiSla- ture to adopt an act relating to government liability for damage or injury resulting from hazardous recreational activities. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the city council of the city of Seward, Alaska, this 27th day of November, 1989. -1- . . .
