CITY OF SEWARD, ALASKA
RESOLUTION NO. 90-010
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A PREPAYMENT AGREEMENT
BETWEEN THE CITY AND CHUGACH FOREST PRODUCTS, INC.
WHEREAS, pursuant to the provisions of the City of Seward
General Terminal Tariff No.1, Subsection 205(e) (2), the City
Council may grant discount wharfage rates for shippers who
guarantee minimum levels of wharfage payments, regardless of actual
shipments; and
WHEREAS, the Tariff requires such discounted rates be in the
form of a written prepayment agreement; and
WHEREAS, Chugach Forest Products, Inc. (Chugach) wishes to
enter into such a prepayment agreement with the City for the use
of the City's North Dock for the loading and unloading of timber
and timber products; and
WHEREAS, the Prepayment Agreement between the City and Chugach
as attached hereto and incorporated herein has been reviewed and
approved by the city administration and deemed of beneficial
interest to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Prepayment Agreement between the City and
Chugach as attached hereto and incorporated herein is hereby
approved.
Section 2. This resolution shall take effect ten days
following approval.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 22nd day of January, 1990.
