Sponsored by: Arvidson CITY OF SEWARD, ALASKA RESOLUTION NO. 90-149 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, INDEFINITELY POSTPONING A HEARING ON THE VEHICLE FOR HIRE PERMIT OF YELLOW CAB COMPANY OF SEWARD AND AUTHORIZING THE CONCLUSION OF A VOLUNTARY DRUG TESTING PROGRAM TO BE USED AS A MODEL FOR VEHICLE FOR HIRE BUSINESSES IN SEWARD WHEREAS, the City Council has repeatedly expressed its grave concern over what appears to be a continuing and growing substance abuse problem within the City of Seward; and WHEREAS, through the DARE program, community education, and active involvement of the Seward City Police in drug education, the City Council has expressed its desire to deal with this extraordinarily difficult social issue; and WHEREAS, operators of vehicles for hire have a direct impact on the public safety on a daily basis int hat they operate vehicles throughout the City; and WHEREAS, a vehicle for hire business could, in certain circumstances, act as an illegal distribution system for controlled subst9rices within a community; and WHEREAS, the combinat~ofi of dangers posed by the operation of vehicles and the potential use of those vehicles as a soun;e" of distribution for controlled substances can endanger the public health and safety; and / WHEREAS, in.voluntary cooperation with the City, Yellow Cab Company of Seward has indicated a willingnes~{o work toward the development of a voluntary drug testing and prevention program for its drive~s; and / / / WH~AS, such a program would promote the public health and safety and demonstrate a cooperati spirit between businesses within the community and the City all aimed at reducing this public s ty and health danger; and WHEREAS, the City wants to encourage the development of such program and to assist in its'implementation; and WHEREAS, Yellow Cab Company has demonstrated its commitment to positive steps in that regard; /1 ~\ ~ - * - -\L 0, ('?'-J"-- \ \ \.;" \I \ q c' . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 90-149 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The city manager is directed to conclude negotiations for the adoption and implementation with Yellow Cab Company of a voluntary drug testing and prevention program along the general lines outlined in the policy agreement and tentative agreement attached to this resolution. Section 2. Such agreement, if concluded, shall be presented to the City Council at its regularly scheduled meeting or a special work session called for the purpose of dealing with that agreement no later than the end of January 1991. Section 3. In cooperation with Yellow Cab Company and its attorneys, the city clerk and city attorney are directed to attempt to modifY the existing Seward Code in order to provide for such drug testing and prevention programs and to incorporate those procedures int he vehicle for hire procedures set forth in the Code. Section 4. The hearing set for November 26 at a special meeting of the City Council is hereby indefinitely postponed and upon conclusion of a written agreement between the City and Yellow Cab and the approval of that agreement by the City Council shall be canceled. Section 5. This resolution, the tentative agreement and any final agreement between the City and Yellow Cab Company is not to be considered as an admission of guilt or wrong doing by Yellow Cab Company or any of its employeesj/' ;' Section 6.
