<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2000-028 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A LEASE <br />AGREEMENT FOR BOARDWALK LEASE SITE NUMBERS SIX WITH JACK <br />AND SHEILA SCOBY, DBA ORCA ENTERPRISES <br /> <br />WHEREAS, pursuant to the City Council's direction, the Administration issued a Request <br />for Proposals for Boardwalk Lease Site Number 6; and <br /> <br />WHEREAS, one proposal was received from Jack Scoby and accepted by the City of <br />Seward City Council by Resolution 99-166; and <br /> <br />WHEREAS, this lease would add approximately $2,700 per year in lease revenues (an <br />amount similar to other boardwalk lease sites on a square foot basis) divided evenly between the <br />Harbor Enterprise and General funds and include a provision to pay the utility upgrade and <br />boardwalk assessment of approximately $1,735 per year for fifteen years. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The disposition of this lease site by a request for proposals and under the terms <br />and conditions described in the form of attached lease is in the public interest. It is also in the public <br />interest to approve the lease rental rate without an appraisal because the rental rate is the similar to <br />the current rate of similar boardwalk property on a square foot basis, and the rental rate will be <br />adjusted by appraisal to Fair Market Value beginning July 1, 2005 and each five years thereafter. <br /> <br />Section 2. The City Manager is authorized to enter into a lease agreement in substantial form <br />as attached, to record a lease memorandum to reflect such lease between the City of Seward and Jack <br />and Sheila Scoby, dba Orca Enterprises, for Boardwalk Lease Site Number 6 and to make such <br />changes to the attached lease as necessary to finalize the lease but without substantively changing the <br />terms as described in the attached lease. <br /> <br />Section 3. This resolution shall take effect thirty (30) days after passage and posting as <br />required by the City Code <br /> <br />PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28th day <br />of March 2000. <br />
