CITY OF SEWARD, ALASKA
RESOLUTION NO. 90-078
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE SUBLEASE OF
CITY-OWNED PROPERTY BY KENAI FJORDS TOURS, INC.,
TO WAYNE CARPENTER, DBA SEWARD SALMON BAKE AND BBQ
WHEREAS, Kenai Fjords Tours, Inc., previously leased from the
city of Seward a portion of Block 8, Oceanview Subdivision, (RE-
072) for operation of a sightseeing cruise business; and
WHEREAS, after outgrowing this facility, Kenai Fjords Tours,
Inc., constructed a new building on a different site, leaving lease
site RE-072 available for other uses; and
WHEREAS, Kenai Fjords Tours, Inc., has requested City Council
consent to the sublease of the building and a portion of the
grounds within its lease site to Mr. Wayne Carpenter, dba Seward
Salmon Bake and BBQ, for the operation of a restaurant; and
WHEREAS, the Seward Zoning Code allows the proposed use within
the Harbor Commercial District by Conditional Use Permit, and that
permi t has been requested and will be acted upon by the Seward
Planning and Zoning Commission at its July 11, 1990, meeting;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council consents to the sublease of
facilities and land on lease site RE-072, which is more particular-
ly described as a portion of Block 8, Oceanview Subdivision, by
Kenai Fjords Tours, Inc., to Wayne Carpenter, dba Seward Salmon
Bake and BBQ.
Section 2. This consent to sublease is contingent upon the
issuance of any required permits for the proposed business
including the issuance of a Conditional Use Permit by the Seward
Planning and Zoning Commission for a restaurant facility.
Section 3. The lessor, Kenai Fjords Tours, Inc., remains
fully responsible for all terms and conditions outlined in its
lease agreement with the city.
Section 4. The sublessee is hereby required to provide a
certificate of insurance in an amount not less than $300,000 naming
the city of Seward as a named insured.

Section 5. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 9th day of July, 1990.
