HomeMy WebLinkAboutRes1995-005 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 95-05 Substitute A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A CONDITIONAL USE PERMIT TO DONNA MAREK AND TERRY LEE DBA ALASKAN NIBBLES AND CHIPS FOR OPERATION OF A SELF-CONTAINED FAST FOOD WAGON ON TAX PARCEL 147-33-08 WITHIN BLOCK 6, OCEANVIEW SUBDIVISION WHEREAS, Donna Marek and Terry Lee, with the concurrence of the Lessee, Intec Inc., dba Alaska Treks N Voyages, have requested a Conditional Use Permit to operate a self-contained fast food restaurant to be located on Tax Parcel 147-33-08 within Block 6, Oceanview Subdivision, in the Harbor Commercial zone; and WHEREAS, an application meeting the requirements of Section 15.1O.320(B) was submitted and received on February 6, 1995; and WHEREAS, a duly advertised public hearing meeting the requirement of Section 15.01.040 was held by the Planning and Zoning Commission on March 1, 1995; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The proposed use is found to satisfy the conditions specified in Section 15. 10. 320(D) of the Seward City Code. Section 2. The City Clerk is hereby authorized to issue a Conditional Use Permit to Donna Marek and Terry Lee for operation of self-contained fast food restaurant located on Tax Parcel 147-33-08 within Block 6, Oceanview Subdivision, subject to the following conditions: a. This permit is effective April 15, 1995, and expires September 30, 1995, contingent upon City approval of the sublease of a portion of lease site L- 049, Intec. Inc., dba Alaska Treks N Voyages. b. After June 11, 1995, the date of expiration of the lease with Intec Inc., dba Alaska Treks N Voyages, Donna Marek and Terry Lee, dba Alaskan Nibbles & Chips, will be required to obtain approval from the City for use or lease of the property. The propane tank located at the rear of the trailer must be secured so that it is safe from vehicle traffic and cannot be knocked over. d. The tires must be blocked and the trailer fully skirted. e. The unit is totally self contained and not "hard" connected to city utilities. f. The operator must provide on-site parking as provide by SCC ~ 15.1O.215(4,b) or pay the assessment fee required by SCC ~ 15.10.245. g. The operator shall maintain the site free of litter at all times through the use of on-site covered trash receptacles and be responsible for disposing of the rubbish accumulated in the receptacle in accordance with SCC ~ 14.05. h. The operator must conform to the requirements of the local sign code. Portable signs are prohibited and temporary signs are allowed for not more than fourteen days within any ninety-day period. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 1st day of March, 1995.
