HomeMy WebLinkAboutRes1995-018 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2S:18 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A LIMITED CONDITIONAL USE PERMIT TO HOPE E. MILLER, DBA CLE' CAFFE' FOR OPERATION OF A COFFEE CART ON BOARD- WALK SITE NUMBER 1, BLOCK 6, OCEANVIEW SUBDIVISION, THROUGH SEPTEMBER 30, 1995 WHEREAS, Cindy Ecklund submitted a request for a Conditional Use Permit to operate a self-contained coffee cart on Boardwalk Site No.1, Block 6, Oceanview Subdivision which is zoned Harbor Commercial; and WHEREAS, transient merchants are allowed in the Harbor Commercial District by Conditional Use Permit; and WHEREAS, an application meeting the requirements set forth in ~ 15. 10. 320(B) of the Seward Zoning Code was submitted and received on May 31, 1995; and WHEREAS, a duly advertised public hearing, meeting the requirements set forth in ~ 15.01.040 was held by the Planning and Zoning Commission on July 5, 1995. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The proposed use satisfies the conditions specified in ~ 15. 10. 320(D) of the Seward Zoning Code. Section 2. The City Clerk is authorized to issue a Conditional Use Permit to Hope E. Miller, dba Cle' Caffe' for operation of a self-contained coffee cart on Boardwalk Site No.1, Block 6, Oceanview Subdivision for a period ending September 30, 1995, subject to the following conditions : 1. The permit expires on September 30, 1995. 2. The applicant shall comply with City Council Resolution No. 94-101, regarding subletting City lease property. 3. In conformance with the Seward Zoning Code, the operator shall pay the annual parking assessment fee for one (1) parking space. 4. The unit is to be totally self-contained and not "hard" connected to city utilities. Seward Planning and Zoning Commission Resolution No. 95-18 5. The operator shall maintain the site free of litter at all times through the use of on- site covered trash receptacles and be responsible for disposing of the rubbish accumulated in the receptacles in accordance with SCC ~ 14.05. 6. The public restrooms located within the Harbormaster building shall not be used for waste disposal or for cleaning equipment. 7. The business owner shall comply with the requirements of the local sign code which prohibits portable and off-premise signs. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 5th day of July, 1995.
