HomeMy WebLinkAboutRes1995-022 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 95-22 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, RECOMMENDING AMENDMENT TO SCC CHAPTER 15.10 REGARDING PARKING REQUIREMENTS WHEREAS, continuous use, interpretation and review of the Seward Zoning Code, has resulted in the discovery of certain parking requirements which require revision and clarification; and WHEREAS, there is a need to amend certain sections of the Zoning Code, parking requirements in order to more accurately represent the policy values and specific development characteristics of the community; and WHEREAS, it is necessary that the City Council adopt the proposed amendments prior to implementing the City Strategic Plan, parking recommendations in order to minimize interpretation conflicts. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The attached proposed ordinance, incorporated herein by reference, is forwarded to the Seward City Council for adoption. Section 2. This resolution shall take effect immediately upon its adoption. THE CITY OF SEWARD, ALASKA &k~~ Blaine Bardarson, Chairman AYES: NOES: ABSENT: ABSTAIN: Bardarson, Kincheloe, Niebrugge, Skibeness None Carpenter, Castellina, Clark None Sponsored by: Plannin~ & Zonin~ Commission CITY OF SEWARD, ALASKA ORDINANCE NO. 96-_ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE CHAPTER 15.10, SEWARD ZONING CODE RELATING TO PARKING WHEREAS, continuous use, interpretation and review of the Seward Zoning Code, has resulted in the discovery of certain parking requirements which require revision and clarification; and WHEREAS, in part due to the historical lack of zoning review and enforcement combined with the small lots of the Original Townsite of Seward, certain parking code requirements have proved to be a continual obstacle in reviewing development site plans; and WHEREAS, there is a need to amend certain sections of the Zoning Code, parking requirements in order to more accurately represent the policy values and specific development characteristics of the community; and WHEREAS, the Planning and Zoning Commission reviewed the parking requirements and approved Resolution No. 95-22, recommending the proposed amendments to Seward City Code, Title 15 included in this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The following sections of Title 15 of the Seward City Code are hereby amended to read as follows: SCC ~ 15.10.215 Parking B. For each principal building or use, there shall be no less than the number of off- street parking spaces specified under this section: Land Use Minimum Number of Parking Spaces Required 3. Offices Office buildings (public and private), professional center or clinic, financial institutions and other similar uses 1 parking space for each 300 square feet of net office floor area, but not less than 2 spaces CITY OF SEWARD, ALASKA ORDINANCE NO. 96-_ 7. b. Day Cruise, charter boat operators 1 parking space per 4 persons based on maximwn USCG licensing capacity D. Minimwn Dimensions of Off-Street Spaces and Aisles. The minimum dimensions of spaces and aisles shall be as follows: a. Parking space width shall be at least ten (10) feet b. Parking space length shall be at least twenty feet for angle parking and twenty-three feet for parallel parking c. The minimwn width of aisles providing access to spaces, with one-way traffic, varying with the angle of parking, shall be: Angle of Parking Minimwn Aisle Width Parallel 300 450 600 900 12 feet 11 feet 13 feet 18 feet 20 feet d. The minimwn width for aisles providing access to spaces with two-way traffic shall be twenty-four feet. E. Location. All required parking spaces shall be on the same lot as the principal use served; on abutting lots; or, if it is impractical to provide parking on the same or abutting lots, by conditional use permit on lots within 600 feet by the shortest pedestrian route or greater unspecified distances if served by an established scheduled vehicle shuttle service. Separate or abutting lots are allowed provided that such lots are permitted as a principal or conditional use within the zoning district and there is assurance, by recorded document approved by the city, that the required number of parking spaces shall be maintained on such other lot throughout the life of the principal use or structure served; M. Location on property. Parking spaces shall be permitted in any required yard area, provided that within the residential districts, no parking space shall be permitted within five feet of any side property line. P. Group use of lots. Where more than one tenant or use is included within anyone building or on anyone lot, the parking requirements shall be the sum total of the parking requirements for all of the various tenants or uses. -2- CITY OF SEWARD, ALASKA ORDINANCE NO. 96-_ 1. The aggregation of tenants or uses shall meet all the requirements within the definition of "shopping center" in order to become entitled to utilize the parking ratio specified in ~ 15.10.215 B.5.a. 2. Where a hotel or motel has other principal uses such as restaurants, bar and meeting rooms located on its premises, the principal use requiring the greatest amount of parking shall provide 100% of the required parking spaces and the other uses shall provide, in addition, at least 70% of the parking spaces which would be required if these were stand-alone uses. 3. Where a convenience store includes a self-service gas station, the required parking shall be determined by the parking ratio specified in ~ 15.10.215 BSc. No additional parking spaces will be required for the gasoline service station. Section 2. This ordinance shall take effect ten (10) days following its enactment.
