HomeMy WebLinkAboutRes1997-004 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 97-04 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, EXTENDING THE CONDITIONAL USE PERMIT, ISSUED TO BRAD SNOWDEN ON SEPTEMBER 4, 1996 FOR DEVELOPMENT AND OPERATION OF A HOTEL ON ALASKA RAILROAD LEASE PROPERTY WITHIN THE SMALL BOAT HARBOR, UNTIL MAY 8, 1997 WHEREAS, on September 4, 1996, the Planning & Zoning Commission issued an amended Conditional Use permit to Brad Snowden for the development and operation of a hotel on Alaska Railroad lease property in the Small Boat Harbor; and WHEREAS, the Zoning Code stipulates that an approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed use is not initiated; and WHEREAS, to date a building permit has not been procured and the conditional use has not been initiated; and WHEREAS, SCC S 15.10.320 (E) allows the Commission to grant time extensions not to exceed six months each upon a finding that circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP; and WHEREAS, on February 19, 1997, the applicant requested a six month time extension of the amended CUP. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Additional information is needed from the developer in order for the Commission to determine whether or not circumstances have changed sufficiently to warrant a reconsideration of the approval of the amended Conditional Use Permit issued to Brad Snowden on September 4, 1996. Section 2. In order for the permittee to provide additional information to the Commission, the Conditional Use Permit issued to Brad Snowden on September 4, 1996 is hereby extended until May 8, 1997. Seward Planning and Zoning Commission Resolution No. 97-04 Section 3. The permittee is required to provide the following information to the Community Development Department by April 16, 1997, for review by the Commission at its May 7, 1997 meeting: a. a schedule for completing construction of the realigned Fourth A venue in accordance with the City Engineer; b. a schedule for abating the public nuisance currently on the project site; c. current building elevation and site plans; and d. a written explanation of why circumstances have not changed sufficiently to warrant reconsideration of the CUP approval. Section 4. At its May 7, 1997 meeting, the Commission will review the information presented by Mr. Snowden and determine whether or not circumstances have changed sufficiently to warrant a reconsideration of the conditional use permit approval. If the Commission finds that circumstances have changed sufficiently, an extension of the conditional use permit will not be granted. Section 5. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 2nd day of April, 1997.
