RESOLUTION NO. 21::08 Substitute
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, EXTENDING THE CONDITIONAL USE PERMIT, ISSUED TO BRAD
SNOWDEN ON SEPTEMBER 4, 1996 FOR DEVELOPMENT AND OPERATION OF A
HOTEL ON ALASKA RAILROAD LEASE PROPERTY WITHIN THE SMALL BOAT
HARBOR, UNTIL NOVEMBE~ 1997
WHEREAS, on September 4, 1996, the Planning & Zoning Commission issued an
amended conditional use permit to Brad Snowden for the development and operation of a hotel
on Alaska Railroad lease property in the Small Boat Harbor; and
WHEREAS, the Zoning Code stipulates that an approved conditional use permit lapses
six (6) months after approval if no building permit is procured or if the allowed use is not
initiated; and
WHEREAS, SCC ~ 15.10.320 (E) allows the Commission to grant time extensions not
to exceed six months each upon a finding that circumstances have not changed sufficiently to
warrant a reconsideration of the approval of the CUP; and
WHEREAS, to date a building permit has not been issued and the allowed use has not
been initiated; and
WHEREAS, on April 2, 1997, the Commission approved Resolution No. 97-04, granting
a one month extension of the permit until May 8, 1997 in order to allow time for the permittee
to provide the Commission with additional information; and
WHEREAS, in response to the Commission's request, Mr. Snowden submitted a letter
to the City on April 21, 1997 which stated the following:
1. Shield Paving and Metco have been contacted to pave the relocated Fourth Avenue
between May 7, and May 14, 1997;
2. The cable hazard on the property has been removed and the property will be fenced
within 30 days of completion of the road;
3. The city is in possession of the most current set of site and building elevation
plans;
4. Conditions are sufficiently similar to allow the P&Z Commission to grant an
extension to the CUP; and
