RESOLUTION NO. 21=U
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A SIGN VARIANCE TO SHORESIDE PETROLEUM,
INC. TO ALLOW AN OVERSIZE FREESTANDING SIGN ON LOT lA, BLOCK 3,
JESSE LEE HEIGHTS SUBDIVISION
WHEREAS, Shoreside Petroleum, Inc. has applied for a sign variance to erect a 30 foot
tall freestanding structure with three separate 8 foot by 8 foot illuminated signs totaling 192 square
feet in area on Lot lA, Block 3, Jesse Lee Heights Subdivision located within the Auto
Commercial Zoning District; and
WHEREAS, the maximum allowed height for freestanding signs within the City of Seward
is 20 feet; and
WHEREAS, the maximum allowed size of an internally illuminated freestanding sign in
the Auto Commercial district is 32 square feet; and
WHEREAS, Seward City Code ~ 12.10.055 allows the Planning and Zoning Commission
to grant variances in harmony with the general purpose and intent of the code which includes:
community aesthetics; commercial communication to the public; protection and enhancement of
the historic charm, natural beauty, visual character and identity of the community; and flexibility
for creative and innovative sign designs; and
WHEREAS, the commission may vary the rules, regulations or provisions of the sign
code provided that the commission, upon due and diligent investigation, makes specific findings
that the conditions listed in 12.10.055 (3) have been considered; and
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission has reviewed the request by Shoreside Petroleum, Inc. for
a sign variance along with the City administration's report and made the following findings in
accordance with SCC ~ 12.10.055:
A. The variance will not constitute a grant of special privilege inconsistent with the
limitations upon signage and uses of other properties in the vicinity and zone in which the
property is located.

Seward Planning and Zoning Commission
Resolution No. 97-13
Block 3, Jesse Lee Heights Subdivision, provided that each of the three individual signs on the
freestanding structure shall not exceed 36 square feet each. The total signage fronting the Seward
Highway shall not exceed 200 square feet, excluding the directional and menu board signs,
provided that they are not visible from the public right-of-way.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 2nd
day of July, 1997.
