HomeMy WebLinkAboutRes1997-015 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 21=.l.S A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, RATIFYING THE AUGUST 6, 1997, DECISION TO GRANT JAMES MCCRACKEN A CONDITIONAL USE PERMIT AND A BUILDING SETBACK VARIANCE TO CONSTRUCT AN EIGHT UNIT, MULTI-FAMILY DWELLING ON LOTS 21-24, BLOCK 12, ORIGINAL TOWNSITE OF SEWARD, LOCATED AT 104 WASHINGTON STREET, WITHIN THE URBAN RESIDENTIAL ZONING DISTRICT WHEREAS, James McCracken applied for a conditional use permit and a variance to develop an eight unit multi-family dwelling on Lots 21-24, Block 12, Original Townsite of Seward; and WHEREAS, the subject property is zoned Urban Residential; and WHEREAS, according to the Zoning Code, Land Uses Allowed Table, (15.10.225) a multi-family dwelling (3 or more units) is allowed in the Urban Residential District by Conditional Use Permit; and WHEREAS, a duly advertised public hearing, meeting the requirements of SCC Section 15.01.040 was held by the Commission on August 6, 1997 and September 3, 1997. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning Commission has reviewed the applicant's request for a conditional use permit (CUP) to construct a multi-family dwelling in the Urban Residential District and made the following findings of fact and conclusions: A. A completed application andfee was submitted. The completed application was received by the Community Development Department on July 8, 1997. B. The use is consistent with the purpose of this chapter and the purposes of the zoning district. Zoning. The property is zoned Urban Residential. The Zoning Code allows a multi-family dwelling (3 or more units) in the Urban Residential District by conditional use permit. "!l)pBqlas z: ;:l~Ud ~1-L6 "ON uO~lnlos;:llI UO~SS~UIUIO:) 8u~uoZ puu ~U~uuUld P1UM;:lS Seward Planning and Zoning Commission Resolution No. 97-15 Page 3 The Plan further states that "Developable Land In Seward Is Scarce Yet There Is A Desire To Accommodate As Much Projected Demand For Housing As Possible Within the City Limits In Order To Ensure Sound Community Growth and Development," and recommends continuing every effort to encourage the development of affordable housing for Seward's growing housing needs -- including single- and multi-family housing units. Community Appearance Goal: Improve the appearance of the entire community through increased landscaping, beautification and litter control efforts... The Plan recommended continuing to require landscaping plans as part of conditional use permits, where feasible. E. Public Services and facilities are adequate to serve the proposed site. Adequate water, sewer, and power are available to the property as well as adequate fire, police and solid waste disposal services. A utility pole is located in the northwest corner of the property. The Electric Department has stated that a pedestal or a transformer will be required in the northeast corner of the property. A five foot utility easement is also needed along the north property line. City code requires the use of waste material containers. Construction waste and debris must be removed weekly and upon completion of construction. Jason Enterprises, the current city contractor for solid waste disposal, has previously stated that one dumpster is sufficient for two four-plexes, therefore it is recommended that the permittee locate one dumpster on the property for tenant use. The dumpster must be screened on three sides and located outside of the front yard area. Previous public comments have stressed that there is not adequate space for children to play within the City of Seward, particularly in the residential area on the west side of town. Past multi-family development conditional use permits have required on-site tot lots. During the May 12, 1997, City Council meeting discussion, regarding the vacation of the adjacent rights-of-way, Mr. McCracken stated that he intended to build a play area for his tenants. F. The proposed use will not be hannful to the public safety, health or welfare. This condition has been met. The building construction will meet the requirements of the Uniform Building and Fire Codes. There is no evidence that the proposed multi-family development will be harmful to the public safety, health or welfare. G. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects to the proposed use. The requested variance is the minimum variance necessary to permit the reasonable use of the property for multi-family development. The property is zoned Urban Residential which allows multi-family development of three units or more by Conditional Use Permit. In its discussion, the Commission stated that the north property line was crowded with parking, the required fence or hedge for screening and a utility corridor easement. In order to maintain the required five foot parking setback and protect the adjacent property to the north of the proposed development, the Commission determined that allowing a six foot encroachment into the front setback on the south property line was the minimum variance necessary for the proposed multi-family development. G. The requested variance will not permit a land use in a district where the use is prohibited. This condition has been met. The property is zoned Urban Residential (UR) and a multi-family dwelling of three or more units is allowed in the UR District by Conditional Use Permit. Section 3. Based on the findings and conclusions specified in Section 1 above, the Planning and Zoning Commission authorizes the Community Development Department to issue a Conditional Use Permit to James McCracken for the development of an eight unit multi-family dwelling on Lots 21-24, Block 12, Original Townsite of Seward, subject to the five (5) conditions listed in Section 1 (G). Section 4. Based on the findings and conclusions specified in Section 2 above, the Planning and Zoning Commission authorizes the Community Development Department to issue James McCracken a variance to allow a six foot building encroachment into the 20 foot front yard setback adjacent to Washington Street, on the south side of the property.
