RESOLUTION NO. 28=.U
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, APPROVING BRAD SNOWDEN'S REQUEST FOR A SIX MONTH
EXTENSION OF THE CONDITIONAL USE PERMIT ISSUED FOR THE
DEVELOPMENT OF A HOTEL ON ALASKA RAILROAD LEASE LAND
IN THE HARBOR COMMERCIAL DISTRICT
WHEREAS, in April of 1993 Brad Snowden was issued a Conditional Use Permit to
construct a hotel on Alaska Railroad lease property in the Harbor Commercial District; and
WHEREAS, the Zoning Code stipulates that an approved conditional use permit lapses
six (6) months after approval if no building permit is procured or if the allowed use is not
initiated; and
WHEREAS, SCC ~ 15.10.320 (E) states that the Commission may grant time extensions
not to exceed six months each upon a fmding that circumstances have not changed sufficiently to
warrant a reconsideration of the approval of the CUP; and
WHEREAS, since the original CUP was issued in 1993, the Commission has granted Brad
Snowden six CUP extensions for this project; and
WHEREAS, Mr. Snowden has stubbed water and sewer to the property, and in
conjunction with the Alaska Railroad, relocated and paved a portion of Fourth A venue to
accommodate the hotel project; and
WHEREAS, although Mr. Snowden submitted preliminary construction plans and the
building permit fee to the City in 1997, at Mr. Snowden's request, he withdrew his application
and was refunded 80% of his building permit application fee in January 1998; and
WHEREAS, since Fourth Avenue was paved last summer there has been no positive
action toward the construction of the proposed hotel;
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. Brad Snowden's request for a six month extension of his Conditional Use
Permit to construct a hotel on Alaska Railroad lease property in the Harbor Commercial District
is hereby approved.
