RESOLUTION NO. 28=18
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING HARBOR ENTERPRISES INC. A SIGN
VARIANCE TO ALLOW A 78 SQUARE FOOT, INTERNALLY
ILLUMINATED, FREESTANDING SIGN ON LOT 1, BLOCK 9, ORIGINAL
TOWNSITE OF SEWARD
WHEREAS, on October 6, 1998, Harbor Enterprises Inc. applied for a sign variance to
allow a 78 square foot internally illuminated, freestanding, time and temperature sign on Lot 1,
Block 9, Original Townsite of Seward within the Central Business District; and
WHEREAS, according to Seward City Code ~ 15.20.040, internally illuminated,
freestanding signs in the Central Business District, shall not exceed 32 square feet; and
WHEREAS, the proposed freestanding sign has been located within the Central Business
District, at the corner of Third Avenue and Washington Street, since 1992; and
WHEREAS, Ordinance 98-02, amended the sign ordinance by limiting the size of
internally illuminated freestanding signs to 32 square feet, and consequently made the existing
freestanding sign nonconforming; and
WHEREAS, the Seward City Code ~ 15.20.050, clearly states that nonconforming signs
may not be relocated, except into conformance with the code; and
WHEREAS, Seward City Code ~ 15.20.055 allows the Planning and Zoning Commission
to vary the rules, regulations or provisions of the sign code provided that the commission, upon
due and diligent investigation, makes specific findings that the conditions listed in Section 1 have
been considered.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission has reviewed the request by Harbor Enterprises Inc. for a
sign variance, and the City administration report and made the following findings in accordance
with SCC ~ 15.20.055:
