HomeMy WebLinkAboutRes1999-001 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 22:01 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING GORDON TURNER A CONDITIONAL USE PERMIT TO DEVELOP A HOTEL AT 225 FOURTH AVENUE ON THE SOUTH 7' 2" OF LOT 7 AND ALL OF LOT 8, BLOCK 10, ORIGINAL TOWNSITE OF SEWARD WHEREAS, Gordon Turner currently operates a five unit lodging business at 225 Fourth Avenue within the Central Business District; and WHEREAS, Mr. Turner has applied for a conditional use permit to develop a hotel within the existing building at 225 Fourth Avenue by constructing an additional four guest rooms; and WHEREAS, the Zoning Code ~ 15.1O.225.B (9) states that regardless of business name, the use of more than five guest bedrooms or apartments is considered a motel or hotel for building and other code interpretation purposes; and WHEREAS, according to the Zoning Code, Land Uses Allowed Table, (15.10.225) hotels and motels are allowed within the Central Business District by Conditional Use Permit; and WHEREAS, a duly advertised public hearing, meeting the requirements of SCC Section 15.01.040 was held by the Commission on January 6, 1999. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning Commission has reviewed the applicant's request for a conditional use permit (CUP) to develop a hotel in the Central Business District and made the following findings of fact and conclusions: A. A completed application and fee was submitted. A completed application and the required filing fee was received by the Community Development Department on December 18, 1998. B. The use is consistent with the purpose of this chapter and the purposes of the zoning district. Zoning. The property is zoned Central Business District (CBD). Transportation Facilities Goal: Maintain Seward's Transportation Plan as the primary local tool to ensure safe and convenient transportation facilities that address the needs of Seward residents, businesses and visitors to the year 2010. The Plan recommends continuing to require the development of off-street parking facilities through provisions within the zoning ordinance. E. Public Services and facilities are adequate to serve the proposed site. Adequate water, sewer, and power are available to the property as well as adequate fire, police and solid waste disposal services. City code requires that every business within the City must provide containers suitable for refuse collection (SCC ~ 14.05). Currently, the garbage container rack is located behind the building within the alley right-of-way. F. The proposed use will not be harmful to the public safety, health or welfare. The building construction must meet the requirements of the Uniform Building and Fire Codes. G. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. The garbage container rack must be relocated out of the alley right-of-way; and 2. In accordance with the Comprehensive Plan's recommendation that the development of off-street parking facilities be required through provisions within the zoning ordinance, the developer shall provide one off-street parking space for each of the four new guest rooms; and Section 2. Based on the findings and conclusions specified in Section 1 above, the Planning and Zoning Commission authorizes the Community Development Department to issue a Conditional Use Permit to Gordon Turner for the development and operation of a nine unit hotel on the South 7' 2" of Lot 7 and all of Lot 8, Block 10, Original Townsite of Seward, subject to the two conditions listed in Section 1, Subsection G. Section 3. This resolution shall take effect 10 days following its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 6th day ofJanuary, 1999.
