HomeMy WebLinkAboutRes2001-011 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2001-11 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS- SION, GRANTING A SIGN VARIANCE TO YOUNG YOO TO ALLOW AN OVERSIZE FREESTANDING SIGN ON LOTS 12-14 AND NORTH 1/2 OF 15, BLOCK 15, ORIGINAL TOWNSITE OF SEWARD, AT 313 FOURTH AVENUE WHEREAS, on June 25, 2001 Oriental Garden applied for a sign permit to erect a 15 foot tall freestanding sign with two 32 square foot internally illuminated signs on property located within the Central Business District; and WHEREAS, according to Seward City Code S 15.20.040, the maximum allowed size of an internally illuminated freestanding sign in the Central Business District is 32 square feet, otherwise a maximum of 50 square feet is allowed; and WHEREAS, the Community Development Office issued a sign permit to Oriental Garden for a 32 square foot internally illuminated freestanding sign, and informed the applicant that they could apply for a sign variance from the Planning and Zoning Commission to allow a larger freestanding sign in accordance with Seward City Code 15.20.055; and WHEREAS, on July 19, 2001 Young Y 00 applied for a sign variance to allow a 64 square foot, internally illuminated, freestanding sign on Lots 12-14 and the north 1/2 of Lot 15, Block 15, Original Townsite of Seward; and WHEREAS, Seward City Code S 15.20.055 authorizes the Commission to grant sign code variances that are in harmony with the general purpose and intent of the code which includes: community aesthetics; commercial communication to the public; protection and enhancement of the historic charm, natural beauty, visual character and identity of the community; and flexibility for creative and innovative sign designs; and WHEREAS, the commission may vary the rules, regulations or provisions of the sign code provided that the commission, upon due and diligent investigation, makes specific findings that the conditions listed in 15.20.055 (3) have been considered. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. E. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated. Finding: It does not appear that granting a sign variance will cause any negative effects to the public welfare, or other property in the Central Business Zoning District. Section 2. The Planning and Zoning Commission hereby approves the sign variance request by Oriental Garden c/o Young Y 00 to allow a 64 square foot freestanding sign on Lots 12-14 and the North 112 of Lot 15, Block 15, Original Townsite of Seward subject to the following conditions: 1. The freestanding sign authorized by this sign variance shall be the only freestand- ing sign permitted on the property; and 2. The 32 square foot readerboard portion of the freestanding sign must remain non- illuminated. Section 3. This resolution shall take effect immediately upon its adoption.
