PLANNING AND ZONING COMMISSION
RESOLUTION NO. 2002-02
RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, RECOMMENDING KENAI PENINSULA BOROUGH APPRO V AL OF
THE FOREST ACRES SUBDIVISION, CLAUSEN REPLAT SUBJECT TO
CERTAIN CONDITIONS
WHEREAS, Cline & Associates submitted a preliminary plat of Forest Acres Subdivision,
Clausen Replat to the City of Seward for review and recommendation to the Kenai Peninsula
Borough; and
WHEREAS, the subdivision divides Lot I, Forest Acres Subdivision into two lots; and
WHEREAS, the property is zoned Rural Residential which allows primarily single-family
homes; and
WHEREAS, the new lots meet the minimum lot size and width requirements of the Seward
Zoning Code; and
WHEREAS, the Engineering and Utilities Department has stated that a subdivision
installation agreement is not required for this subdivision; and
WHEREAS, in accordance with Seward City Code, the Commission held a public hearing on
the preliminary plat at its January 8,2001 regular meeting.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends that the Kenai Peninsula Borough approve the
Forest Acres Subdivision, Clausen Replat subject to the subdivider meeting the following conditions:
1. Provide the utility easements identified on the preliminary plat;
2. Dedicate five (5) feet to the Elm Street right-of-way as identified on the preliminary plat;
and
3. Provide an as-built survey to verify that the subdivision will not create any encroachments
into required setbacks.
