<br />Sponsored by: Applicants <br /> <br />CITY OF SEWARD, ALASKA <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION 2003-16 <br /> <br />A RESOLUTION OF THE SEWARD PLANNING AND ZONING <br />COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A <br />SIGN ORDINANCE VARIANCE TO L & J ENTERPRISES INC., DBA <br />THREE BEARS GAS STATION FOR A FREE STANDING SIGN OF <br />TWENTY (20) FEET IN HEIGHT CONTAINING ONE THIRTY-SIX (36) <br />SQUARE FOOT INTERNALLY ILLUMINATED PANEL AND ONE <br />THIRTY-SIX (36) SQUARE FOOT INTERNALLY ILLUMINATED FUEL <br />PRICE PANEL AT LOT 2, CLEARVIEW MANOR, (UNRECORDED) <br />WITHIN US SURVEY 241, 1707 SEWARD HIGHWAY, IN THE AC <br />(AUTO COMMERCIAL) ZONING DISTRICT. <br /> <br />WHEREAS, L & J Enterprises Inc., dba Three Bears Gas Station has applied for a sign <br />variance for a twenty-five (25) foot high freestanding sign with one thirty-six (36) square foot <br />internally illuminated panel and one internally illuminated thirty-six (36) square foot fuel price <br />panel for a total of seventy-two (72) square feet in area on Lot 2, Clearview Manor, <br />(unrecorded), within US Survey 241, 1707 Seward Highway, located within the Auto <br />Commercial Zoning District; and <br /> <br />WHEREAS, the maximum allowed height for freestanding signs within the City of <br />Seward is twenty (20) feet; and <br /> <br />WHEREAS, the maximum allowed size of an internally illuminated freestanding sign <br />within the Auto Commercial Zoning District is thirty-two (32) square feet; and <br /> <br />WHEREAS, a fuel price sign not exceeding twenty (20) square feet per sign face, with <br />one sign allowed per abutting street right-of-way is allowed without a sign permit; and <br /> <br />WHEREAS, the Seward City Code does allow for the applicants to have one <br />freestanding sign and one fuel price sign on the Seward Highway and Iron Drive, neither the <br />applicant, the neighboring residential property owners nor the public will benefit from a <br />freestanding sign and/or a fuel price sign being placed along Iron Drive; and <br /> <br />WHEREAS, Seward City Code 15.20.055 allows the Planning and Zoning Commission <br />to grant variances in harmony with the general purpose and intent of the Code so long as the <br />spirit and benefits of the Code will be preserved; and <br /> <br />WHEREAS, the Commission may vary the rules and regulations or provisions of the <br />Code provided that the Commission, upon due and diligent investigation, makes specific findings <br />that all of the conditions listed in Seward City Code 15.20.055 (3) have been considered; and <br />
