HomeMy WebLinkAboutRes2003-016 Sponsored by: Applicants CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2003-16 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A SIGN ORDINANCE VARIANCE TO L & J ENTERPRISES INC., DBA THREE BEARS GAS STATION FOR A FREE STANDING SIGN OF TWENTY (20) FEET IN HEIGHT CONTAINING ONE THIRTY-SIX (36) SQUARE FOOT INTERNALLY ILLUMINATED PANEL AND ONE THIRTY-SIX (36) SQUARE FOOT INTERNALLY ILLUMINATED FUEL PRICE PANEL AT LOT 2, CLEARVIEW MANOR, (UNRECORDED) WITHIN US SURVEY 241, 1707 SEWARD HIGHWAY, IN THE AC (AUTO COMMERCIAL) ZONING DISTRICT. WHEREAS, L & J Enterprises Inc., dba Three Bears Gas Station has applied for a sign variance for a twenty-five (25) foot high freestanding sign with one thirty-six (36) square foot internally illuminated panel and one internally illuminated thirty-six (36) square foot fuel price panel for a total of seventy-two (72) square feet in area on Lot 2, Clearview Manor, (unrecorded), within US Survey 241, 1707 Seward Highway, located within the Auto Commercial Zoning District; and WHEREAS, the maximum allowed height for freestanding signs within the City of Seward is twenty (20) feet; and WHEREAS, the maximum allowed size of an internally illuminated freestanding sign within the Auto Commercial Zoning District is thirty-two (32) square feet; and WHEREAS, a fuel price sign not exceeding twenty (20) square feet per sign face, with one sign allowed per abutting street right-of-way is allowed without a sign permit; and WHEREAS, the Seward City Code does allow for the applicants to have one freestanding sign and one fuel price sign on the Seward Highway and Iron Drive, neither the applicant, the neighboring residential property owners nor the public will benefit from a freestanding sign and/or a fuel price sign being placed along Iron Drive; and WHEREAS, Seward City Code 15.20.055 allows the Planning and Zoning Commission to grant variances in harmony with the general purpose and intent of the Code so long as the spirit and benefits of the Code will be preserved; and WHEREAS, the Commission may vary the rules and regulations or provisions of the Code provided that the Commission, upon due and diligent investigation, makes specific findings that all of the conditions listed in Seward City Code 15.20.055 (3) have been considered; and OMl '(aAPG uOlI puu AUMqilm plUMas) sailulUO.y laallS OMl suq Alladold S!4l a:>U!s 'AUM -JO-lqilplaalls ilU!Hnqu lad uil!s a:>pd IatlJ auo pUU ailUlUO.y laalls lad uil!s ilU!pUUlsaa.y auo saZ!lOqlnu apo:> uil!s aq.L 'laaJ alUnbs (OZ) AluaMl paa:>xa lOU PIP l! Rather than erect two separate freestanding signs and fuel price signs, the applicant proposes to combine the signs into one freestanding sign of a lesser amount of total allowed square footage. Since the nearby gas station, Essential 1, has a variance allowing a freestanding sign of an approximately similar height and size, granting a variance to the applicants does not give them special privileges. D. That such variance is necessary because of special circumstances such as, but not limited to, health and safety or the size, shape, topography, location or surroundings of the subject property, to provide it with signage use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; Finding: This condition has not been met. There are no special circumstances related to the subject property or surrounding area, which make it necessary to grant a sign variance. The property is mostly cleared, level and has over three hundred (300) feet of frontage on the Seward Highway. The portion of the Seward Highway fronting on the subject property is a 35 mile-per-hour, two lane road with businesses located only on the West side. E. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the subject property or improvements in the vicinity and in the zone in which the subject property is situated; Finding: It does not appear that granting this sign variance will be materially detrimental to the public welfare, or other property in the vicinity or the Auto Commercial Zoning District. Granting this sign variance will prevent the installation of multiple signs that would cause greater visual clutter in general, being particularly injurious to residential properties in the vicinity. Section 2. The Planning and Zoning Commission hereby approves the sign ordinance variance request by L & J Enterprises Inc., dba Three Bears Gas Station for a free standing sign of twenty (20) feet in height containing one thirty-six (36) square foot internally illuminated panel and one thirty-six (36) square foot internally illuminated fuel price panel at Lot 2, Clearview Manor, (unrecorded), within US Survey 241, 1707 Seward Highway, in the AC (Auto Commercial) Zoning District subject to the following conditions: 1. The freestanding sign authorized by this sign ordinance variance shall be the only freestanding sign permitted on the property. 2. The fuel price panel shall only contain fuel price information and no other fuel price sign shall be allowed on the lot. 3.
