PLANNING AND ZONING COMMISSION
RESOLUTION NO. 2004-07
RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, RECOMMENDING KENIA PENINSULA BOROUGH APPROVAL
OF JESSE LEE HEIGHTS SUBDIVISION, ADDITION NO.5 REPLAT
WHEREAS, McLane Consulting Group, representing Safeway Inc. had submitted a
preliminary plat of Jesse Lee Heights Subdivision, Addition No.5 Replat to the City of Seward
for review and recommendation to the Kenai Peninsula Borough: and
WHEREAS, the subdivision replat vacates the interior lot lines of Lots 4, 5, and 6A,
Block 3 Jesse Lee Heights Subdivision and creates one Tract 4A; and
WHEREAS, the property is located in the Auto Commercial Zoning District; and
WHEREAS, the property is currently serviced by municipal water, sewer and electric;
and
WHEREAS, the Engineering and Utilities Department has stated that a subdivision
installation agreement is not required for this subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends that the Kenai Peninsula Borough approve the
Jesse Lee Heights Subdivision, Addition No.5, Tract 4A, Block 3 Replat. subject to the sub-
divider meeting the following condition:
1. A fifteen (15) foot wide utility easement from the East lot line of Tract 4A of Jesse
Lee Heights Subdivision No.5 shall be added to the plat notes.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 16th
day of April 2004.
