HomeMy WebLinkAboutRes2000-056 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2000-056 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A NEW LEASE AGREEMENT WITH JACK SCOBY FOR A PORTION OF BLOCK 8, OCEANVIEW SUBDMSION, SEWARD RECORDING DISTRICT, THIRD JUDICIAL DISTRICT, STATE OF ALASKA, FOR THE PURPOSES OF OPERATING A RETAIL MERCHANDISE FACILITY. WHEREAS, Jack Scoby (Lessee) has proposed a lease term extension to his existing lease agreement, Lease Number RE-68-0n with the City of Seward for a portion of Block 8, Ocenaview Subdivision, Seward Recording District, Third Judicial District, State of Alaska, for the purposes of operating a retail merchandise facility; and WHEREAS, the current lease has been in effect since November 9, 1988 and the Lessee has established a retail merchandise facility on the leased land; and WHEREAS, the Lessee has recently completed extensive capital improvements to the leased property and desires to take advantage of improved financing arrangements and can only do so by extension of his lease term; and WHEREAS, the City desires to update the form and content of the old lease and bring the lease up to date by terminating Lease Number RE-68-0n and entering into a new lease agreement with Lessee using current forms, terms and conditions in conjunction with the lease term extension; and WHEREAS, it is in the public interest to promote continued and increased retail activity of this type within the City and benefit the community through stability, job groWth and other related economic impacts; NOW, THEREFORE, BE IT RESOLVED BY mE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. It is the public's interest to enter into a new lease agreement with Jack Scoby for this property. The lease rate provided in the lease is at the City's recently appraised Fair Market Rental Value. Section 2. The City Manager is hereby authorized to enter into a new lease agreement with Jack Scoby, attached and incorporated herein by reference, in substantial form as attached hereto, to record a lease memorandum to reflect such lease, and to make such changes to the attached lease as necessary to finalize lease between the parties but without changing the substantive terms as described in the attached lease. CITY OF SEWARD, ALASKA RESOLUTION 2000-056 Section 3. This resolution shall take effect thirty (30) days after its adoption.
