ORDINANCE 2000-01
AN ORDINANCE OF THE CITY COUNCIL OF mE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE, TITLE 8, BUSINESS
REGULATIONS AND LICENSING, CHAPTER 8.05, BY ADDING
LANGUAGE ALLOWING FOR A PERMIT FOR ALCOHOLIC
BEVERAGES IN PUBLIC PLACES WITH A PAVILION RESERVATION
OR SPECIAL EVENT PERMIT.
WHEREAS, in response to rowdy drinking parties along Waterfront Park during the 1998 July
Fourth Celebration; and
WHEREAS, in response to the City Administration receiving public input on a desire to limit
alcohol consumption and allow alcohol consumption only in accordance with a pavilion reservation
or a special event permit; and
WHEREAS, although Ordinance 99-02 led to the desired outcome of controlling drinking
alcohol in public places, it also had the effect of limiting the public consumption of alcohol on all
public property except public property identified as a pavilion; and
WHEREAS, there is a need to create an administrative process allowing for exceptions to the
hard rule of total alcohol prohibition in public places unless it is identified as a pavilion; and
WHEREAS, the administrative process recommended calls for the Chief of Police's written
approval for the public consumption of alcohol and the issuance of a special event permit by the City
Manager, or the Chief of Police's written approval for the public consumption of alcohol and a
pavilion reservation issued by the Parks and Recreation Director;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. SCC ~8.05.015, Consumption in public places, unlicensed establishments, etc.
prohibited is hereby amended to read as follows:
A.
Except as provided in subsection C of this section, no person shall have an open
bottle, glass or other open container containing any intoxicating liquor in such
person's possession on the public streets, parks or in any other public place, including
any store or establishment open to or doing business with the public not licensed to
sell intoxicating liquor for consumption on the premises.

B. No person who owns, operates or controls any public establishment or store shall
permit a violation of subsection A of this section to occur on such premises.
C. No exception to the provisions of subsection A of this section shall be allowed
without prior written approval granted by the chief of police or hisiher designee. A
request must be accompanied by:
1 . a pavilion reservation issued by the parks and recreation director or the
director's designee;
2. a special event permit issued by the city manager or his/her designee.
D. Approval granted under subsection C shall be limited to specified time periods and
defined areas subject to conditions necessary or desirable to protect the public health,
safety and welfare. The chief of police, parks and recreation director and city manager
may adopt regulations applying and interpreting this section and may prescribe forms
for administering this section. (Ord. 294, 1960; Ord. 416, 1976; Ord 99-02, 1999)
Section 2. This ordinance shall take effect ten (10) days following its enactment.
