HomeMy WebLinkAboutOrd2000-002 I I I Sponsored by: Planninl! and Zoning Commission Introduction Date: Januarv 24 2000 Public Hearing Date: February 14 2000 Enactment Date: February 14 2000 CITY OF SEWARD, ALASKA ORDINANCE 2000-02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE LAND USE PLAN AND ZONING DESIGNA- TION OF THE WEST 64 FEET OF LOT BG, FOREST ACRES SUBDIVI- SION WHEREAS, Sandra Schafer has submitted an application requesting that the Land Use Plan and Zoning designation ofthe westernmost 64 feet of Lot BG, Forest Acres Subdivision be changed from Rural Residential to Single-Family Residential in order to allow a subdivision of Lot BG into two lots; and WHEREAS, the preliminary plat of Forest Acres Subdivision, Schafer Replat identifies proposed Lot BG-l to be 10,620 square feet in size and Lot BG-2 to be 27,780 square feet; and WHEREAS, the current Rural Residential zoning of Lot BG does not allow the subdivision of any lots below the minimum lot size of 20,000 square feet; WHEREAS, Lot BG is contiguous with a Single-Family Residential zoned property to the west; and WHEREAS, the proposed Land Use Plan and Zoning amendment is consistent with both the Comprehensive and Strategic Plans in that it will allow for the development of an additional single- family dwelling; and WHEREAS, at its January 5, 2000 meeting, the Planning and Zoning Commission reviewed the application, held a public hearing, and recommended Council approval of the proposed Land Use Plan and Zoning amendments included in this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The City of Seward Land Use Plan and Zoning Map are hereby amended by conditionally changing the land use plan and zoning designation of the westernmost sixty-four feet of Lot BG, Forest Acres Subdivision, from Rural Residential to Single-Family Residential as depicted by proposed Lot BG-l on the preliminary plat attached hereto as Exhibit A and hereby incorporated by reference. Section 2. The land use designation and rezone of the westernmost 64 feet of Lot BG, Forest Acres Subdivision, to Single-Family Residential is conditional and requires the property owner (i) to remove all livestock and existing fencing from the area of proposed Lot BG-l within six months of the effective date of this ordinance; (ii) to remove all structures and fencing located on the lot line CITY OF SEWARD, ALASKA ORDINANCE 2000-02 between proposed lot BG-l and BG-2 within six months of the effective date of this ordinance; and (iii) to properly file with the recorder's office the final plat subdividing Lot BG in substantially the same manner as depicted on the preliminary plat of Forest Acres Subdivision, Schafer Addition, attached as Exhibit A hereto, within one year of the effective date of this ordinance. Section 3. Should anyone of the conditions listed in Section 2 hereof not be met within the specified time period, the land use and zoning designation of the entire parcel ofland comprising the original Lot BG, Forest Acres Subdivision, shall revert to Rural Residential, the same zoning as existed for the property prior to date of this ordinance. Otherwise, upon filing the plat in substantially the same form as the preliminary plat attached as Exhibit A hereto, and meeting all other conditions of Section 2 hereof, the Land Use Plan and Zoning Maps shall designate proposed Lot BG-l as Single-Family Residential and BG-2 as Rural Residential. Section 4. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 14th day of February, 2000.
