CITY OF SEWARD, ALASKA
RESOLUTION NO. 95-078
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING THE COUNCIL'S
RULES OF PROCEDURE
WHEREAS, on March 14,1994, the City Council approved Resolution No. 94-031.
adopting formal Rules of Procedure; and
WHEREAS, since that time, several changes in the City Code, the City Charter and
State Statutes have invalidated certain sections of the adopted Rules of Procedure; and
WHEREAS, the City Council wishes to amend its Rules to conform to City and
State law;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council's Rules of Procedure are hereby amended as set forth
on the attached "Summary of Amendments" and the City Clerk is instructed to revise the
Rules accordingly.
Section 2. The City Clerk is further instructed to distribute copies of the revised
Rules of Procedure to the City Council, its Boards and Commissions and the City
Administration.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
10th day of July, 1995.

SUMMARY OF AMENDMENTS
Resolution No. 95-078
INTRODUCTION. A few minor amendments have been made to the introduction to
reflect meeting schedule changes for the Historic Preservation Commission and the date
of the annual joint work session between the Council and the Planning Commission.
RULE 4. Last year's amendments to the City Charter allowed the Council to amend the
City Code to allow organization of the Council within 30 days after the election rather
than on the Monday following the election as currently required. The amended Rule
reads as follows:
The City Council must meet and organize not later than 30 days after each
regular city election. At this organizational meeting, the Council elects one of its
members to act as Vice Mayor in the absence of the Mayor. In addition, the Mayor
appoints the Council liaisons to the Community Hospital Board and the Planning
Commission and appoints the Council representative to the Kenai Peninsula
Borough Economic Development District. (SCC & 2:10.020)
RULE 5. As a result of a Charter amendment approved by the voters on October 4,1994,
the second sentence of this rule has been amended to read as follows:
The Mayor has no regular administrative or executive duties.
RULE 10. The City Code has been amended by removing the requirement that work
sessions be held in the regular meeting place of the Council. This Rule has been
amended to reflect this change.
RULE 16. This Rule refers to the Attorney Evaluation Form (Appendix A-5). This form
has been reviewed and revised, and the new form has been included in the Appendix.
RULE 22. This Rule has been amended to reflect the current city PERS contribution rate
(9.52%) and the projected FY 1996 rate (6.73%). All other rates listed are current.
RULE 28. This Rule has been amended to reflect the changes approved in Ordinance
No. 94-39. Section (b) will read as follows:
(b) No member of Council may be compelled to vote on a question. The
vote of any member who is present at a meeting and who refuses or fails to cast a
vote on a matter upon which he is qualified to vote shall be cast on the side
receiving the greatest number of votes. In the event of a tie vote, a vote so cast
shall be cast as a "no" vote. (SCC & 2.10.035)
RULE 29. This Rule has been amended to reflect the October 4,1994, amendment to the
Charter. Standing committees of the Council are no longer prohibited.
RULE 32. This Rule conflicts with SCC ~ 2.15.035. The Council has approved an
ordinance amending the City Code to allow both the Clerk and the Attorney to sponsor
ordinances and resolutions since this has been the practice for some time. The Rule has
also been amended to reflect that the City Clerk may prepare an ordinance on her own
initiative.
RULE 35. This Rule has been amended to reflect the existence of the Historic
Preservation Commission and the appointment of a Council liaison to the Planning
Commission.
SECTION V. The subsection dealing with open public meetings has been amended to
reflect the new State law regarding open meetings.
