RESOLUTION NO. 87-099
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROPRIATING FUNDS FOR THE COMMUNITY
SCHOOLS PROGRAM AND AUTHORIZING A PUBLIC USE AGREEMENT
BETWEEN THE CITY AND THE KENAI PENINSULA BOROUGH
SCHOOL DISTRICT
WHEREAS, the Kenai Peninsula Borough School District
has eliminated the Community Schools Program for the city of
Seward; and
WHEREAS, the KPBSD has agreed to enter into a public
use agreement with the city of Seward to make the Community
Schools Program available to residents of the city once
again; and
WHEREAS, as part of the agreement, the KPBSD has agreed
to provide the city a funding grant totalling $4814 to
partially fund a part-time community schools coordinator;
and
WHEREAS, under this agreement, the city of Seward would
administer the Community Schools Program and would provide
funding totalling approximately $5900 to fund the coordina-
tor's position and to operate the program; and
WHEREAS, it is anticipated that the total amount
budgeted by the city for this program will be recovered from
user fees;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The city manager is authorized to accept a
grant from the Kenal Peninsula Borough School District,
raising the budgeted revenues from "Miscellaneous Parks &
Rec Grants", Account No. 101-000-347-13-00, by $4814.
Section 2. The city manager is also authorized to
increase the budgeted revenues from "Parks & Rec User Fees",
Account No. 101-000-347-10-00, by $6186.
Section 3. The city manager is further authorized to
increase the budgeted expenditures in the Parks and Recre-
ation Department budget by $ll,OOO.

Section 5. This resolution shall take effect immedi-
ately upon its adoption.

AGREEMENT
~ This agreement made and entered into this 20 day of O::tober, 1987, by
and between the City of Seward, Alaska, hereinafter referred to as the City, and the
Community Schools Program of the Kenai Peninsula Borough School District,
hereinafter referred to as the Program.
WI'INESSEI'H:
WHEREAS, the City has provided recreational
opportuni ties and the Program has available additional
and recreational purposes, and
facilities and activity

WHEREAS, the City and the Program share corrrnon goals to provide opportunities
and activities for the physical, mental and cultural development of their respective
client groups through the programs, and
WHEREAS, the benefits from limited financial resources can be maximized by
these agencies working together to provide facilities and programs to achieve their
comnon goals,
N:W THEREFrnE WI'INESSEI'H:
In consideration of the premises and agreements contained herein, the parties
hereto agree as follows:
1. CXIVMJNITY SCHCOIS PRcx:RAM PROVIDED. The City agrees to provide a
Conmunity Education program among children, youth and young adults,
adults and senior citizens in various sports, special events, hobbies,
educational and other recreational activities. The extent, content and
management shall be decided by the City, with appropriate advice and
suggestions from the Program.
2. CXIVMJNITY SCHCOIS PRCGRAM cx:NI'ENI'. The program may include, but not
limited to the following:
a. Educational opportunities for all ages
b. Children's summer craft and playground activities;
c. Supervised gym activities such as basketball and
volleyball;
d. Periodic special events such as Jesse Owens track meet,
field trips, dances, etc.; and
e. K-12 enrichment activities
3. PERSONNEL. The City shall hire qualified personnel with the advice and
consent of the Program to organize, supervise and direct program
services. Such personnel shall be under the direct supervision of the
Director for Seward Parks and Recreation, except during his/her absence
at which time supervision of personnel shall be delegated by the
Director to his/her designee. The coordinator shall also be supervised
by building principal(s) while using school facilities and equipment.
All personnel employed as Community Schools Coordinator shall be
employees of the City of Seward and the personnel regulations of said
City shall apply.

4.
USE OF FACILITIES. The Program agrees to make the public school
facilities in the City of Seward available for Program activities with
the provision that preference in scheduling of them shall be given to
the organized activities of the Kenai Peninsula Borough School District.

5. PAYMENT. In consideration for the services to be provided, the Program
agrees to pay the City the sum of $48l4 for the period through June 30,
1988. This represents the Program share of equal matching funds.
Renewal of this agreement from year to year is subject to the approval
of the Seward City Council and the Program. It is understood that
continuation is contingent upon an annual fiscal plan and agreement
between the Program and the City.
Payments shall be made to the City upon request before December 30,
1987.
6. FISCAL AGENT. The City of Seward shall act as the sole fiscal agent for
the conduct of the Community Schools Coordinator position in Seward.
a. The district expressly agrees to make the facilities provided
hereunder available to the City at a rate of $l per class/activity
hour per participant. Funds raised in this manner shall be paid
to the school hosting said activities.
7.
RERRrS REQJIRED. Prior to conmencement of quarterly activities, the
Program shall submit to the City, a written narrative of the programs
and activities and make suggestions concerning same. Reasonable
progress reports shall be made upon request.

8.
HOLD HARMLESS. The City agrees to defend and hold harmless the Kenai
Peninsula Borough School District and its Conrnunity Schools Program from
any claim for inj ury to person or damages to property, or other
liability or claim, or damages that may occur in connection with use of
any facility owned or operated by the City when used for this program.
9. WJIFMENI'. The City and Program have various equipment and supplies
used in the conduct of it's programs that may, upon request and
approval, be made available to facilitate and support the provision of
recreational and educational programs conducted under this agreement.
10. AtJIKRIZED AGENTS. The individuals authorized to act as the agents on
behalf of the parties to this agreement are:
