RESOLUTION NO. 87-100
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT OF SALE OF THE CITY'S
POLICE DOG TO MICHAEL CHAPMAN
WHEREAS, Bingo, the city's police dog, was donated to
the city several years ago by the State Elks Association as
a part of its drug awareness program; and
WHEREAS, since acquiring the dog, the city's use of his
expertise in drug and security work has been severely
limited by both legal and health problems; and
WHEREAS, surgery to correct Bingo's
placia was unsuccessful, resulting in the

WHEREAS, Bingo is currently residing with Corporal
Michael Chapman and his family as a family pet; and
WHEREAS, Corporal Chapman has agreed to accept owner-
ship of the dog, releasing the city from the responsibility
to provide veterinary care and any other extraordinary costs
which might arise;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The public interest would best be served by
waiving the requirement to dispose of the city's police dog
by public bid.
Section 2. The City Manager is hereby authorized to
execute an agreement of sale of the city's police dog,
Bingo, to Corporal Michael Chapman for the sum of $1.00. A
copy of the agreement is attached and incorporated herein by
reference.
Section 3. This resolution shall take effect immedi-
ately upon its adoption.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, this 26th day of October , 19 87.

.AGREEMENT OF
This agreement of sale is entered into between the City of Seward
("Seller") and Michael Chapman ("Buyer") for the purpose of transferring
ownership of a certain German Shepard dog, (hereafter referred to as
"the dog", aka "Bingo") currently owned by the Seller.
Both Buyer and Seller acknowledge the following matters of fact:
Buyer currently holds the position of Corporal in the Seller's
municipal Police Department.
The dog was donated to the Seller by the Alaska State Elk's
Association, a non-profit organization, to be used primarily for
the enforcement of laws regulating sale and possession of
controlled substances.

The dog has received extensive specialized training in both police
and security work.
Buyer has received specialized training in the handling of the dog
and is familiar with the dog
Buyer has had custodial control of the dog on behalf of the Seller
since the dog was acquired by the Seller. During that time, the
dog has been housed at the Buyer's personal residence.
The dog has experienced medical problems, including serious
arthritis in his left, rear knee.
These medical problems have limited the dog's usefulness to Seller
in the area of law enforcement.
Recognizing the above matters of fact, for the sum of one dollar ($1.00),
the Seller does hereby sell and convey to Buyer all ownership of, and
interest in, the dog.

Seller warrants that it is the lawful owner of the dog and is not
constrained by either covenant or law from disposing of the dog to
Buyer.
Buyer understands and acknowledges that ownership of the dog
transferred "as is", with no warranty regarding the dog's health or
condition. Buyer agrees to accept full responsibility for the dog and

will not look to Seller to provide any support or contribution, financial
or otherwise, toward the maintenance or care of the dog.
