CITY OF SEWARD, ALASKA
RESOLUTION NO. 88-125
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, CONCERNING THE CONSTRUCTION
AND PAVING OF COTTOt~OOD AVENUE
W1IEREAS, the Kenai Peninsula Borough School District is
constructing a new elementary school in Seward; and
WHEREAS, the extension of Cottonwood Avenue, a city
street, from Dimond Boulevard to the school, is necessary
for access, and the school would be the sole user of this
portion of Cottonwood Avenue; and
WHEREAS, the preliminary construction drawings showed
Cottonwood Avenue to be a paved street, with a sidewalk,
connecting to paved parking areas and access roads within
the school parameter; and
WHEREAS, the KPBSD has stated that district policy may
not permit paving city streets accessing school facilities,
and they may limit improvements to Cottonwood Avenue to a
gravel street, expecting Seward to pave the street; and
WHEREAS, it will be impossible to adequately maintain a
gravel street subject to heavy bus and other vehicular
traffic generated by the school with the city's present
resources; and
WHEREAS,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The Kenai Peninsula Borough School District
is requested to construct Cottonwood Avenue, from Dimond
Boulevard to the school, with pavement and sidewalk as shown
in the preliminary design.
Section 2. Be it further resolved that the city of
Seward will not assume responsibility for maintenance of
Cottonwood Avenue from Dimond Boulevard to the school until
it has been constructed to a reasonable standard which
includes a pedestrian walkway or sidewalk, paving and street
lights.

Section 3. The city may program capital funds in
future years for construction of improvements to Cottonwood
Avenue; however, such funding will be programmed after other
city streets have been repaired and paved.
Section 4. This resolution shall take effect immedi-
ately upon its adoption.
