RESOLUTION NO. 89-024
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEvlARD, ALASKA, AUTHORIZING RENTAL AND APPRAISAL
AMENDMENTS TO BOARDWALK LEASE SITES NO.1, NO.2,
NO.3, NO.4, AND NO. S
WHEREAS, Boardwalk Lessees have requested review of
their lease rates in relation to other nearby lease sites;
and
WHEREAS, an independent appraiser hired by the city
corroborated the existing lease rates as being at fair
market value based on the previous willingness of Lessees to
pay that rate; and
WHEREAS, Boardwalk Lessees again asked that their lease
rates be lowered and brought more in line with rates charged
other Harbor area Lessees; and
WHEREAS, on January 9, 1989, the Seward City Council
agreed to set the lease rates for Boardwalk Sites No.1
through No. S at $1.00 per square foot, provided the leases
are reappraised under the same five year period as other
city leases;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to
execute lease amendments, attached and incorporated herein
by reference, for Boardwalk Lease Sites No.1 (RE-047), No.
2 (RE-048), No. 3 (RE-OSO), No. 4 (RE-OS6), and No. S
(RE-OS8).
Section 2. The City Council finds that a reduction in
lease rates as authorized in Section 1 (above) is more
reflective of the fair market land lease value of the
subject properties than the originally agreed up lease rate
and is, therefore, in the public interest.
Section 3. This resolution shall take effect thirty
(30) days following passage and posting as required by law.

SEWARD, ALASKA, this 28th day of March , 19~.

The CITY OF SEWARD, ALASKA, a home rule municipal
corporation, organ~zed and existing under the laws of the state of
Alaska, hereinafter referred to as "CITY", and TRAILS NORTH INC.
hereinafter referred to as "LESSEE", hereby agree that the Lease
between them for Seward Small Boat Harbor Boardwalk S~ te # 3
w~th~n Block 6 Oceanview Subd~vis~on, dated April 28, 1986, ~s
hereby amended as follows:
DELETE Sect~ons 1 and 2 w~ thinA.RI.I~1.E..V.l.... ..REliT on Page 4, and
substitute in their stead the follow~ng:
1. Any and all annual rental due under this Lease shall
be paid in advance upon commencement of th~s Lease ~n quarterly
~nstallments on or before January 1, April 1, July 1 and October 1
of each succeed~ng year.
2. The rental shall be determ~ned as follows:
. From the 14th day of May 1986 thru the 30th day of June
1988, the lease rate shall be $1500 per annum. Beginn~ng the 1st
day of July, 1988 thru the 13th day of May 1990, the rental rate
w~ll be $1.00 per square foot per year. Not less than n~nety (90)
days pr~or to the expirat~on of every f~fth lease year thereafter,
C~ty, at its own expense, shall employ an independent MAl
