RESOLUTION NO. 85-105
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SB'-lARD, ALASKA, AUTHORIZING THE PURCHASE OF EIGHT RADAR AND
TEN PORI'ABLE BREATH TEST UNITS FOR THE SEWARD POLICE DEPARI'MENT
WITHOUT FULL UTILIZATION OF THE BID PRCCEDURFS sm FORl'H IN
S~ION IO-8 OF THE SEWARD CITY CODE
WHEREAS, the City of SelNard Police Department is a participant
in a State of Alaska grant entitled the REDDI project; and
WHEREAS, the City of SelNard Police Department is in need of
radar and breath-testing units and has participated in the aforerren-
tioned project which will pay for the City's units and for other units
to be distributed to other area police agencies; and
WHEREAS, the City Police Chief has investigated the usage of
radar units within the Kenai Peninsula Borough; and
WHEREAS, it was discovered that two specific brands of radar
units and one brand of breath-testing units are being used and have been
found necessaIY to suit minimmn requirerrents for service, good response
to service requests and effectiveness in the field; and
WHEREAS, six of the radar units needed are manufactured by the
KUSTOM Corrpany and are designed to be used as both nobile and stationaIY
radar units and further are =rrpatible with existing equiprrent; and
WHEREAS, two of the needed radar units are manufactured by
DOCATUR Company and are designed as hand-held units only and further are
suitable to the envirol1IlEnts of the City of Seward; and
~'VHEREAS, the breath-testing equiprrent manufactured by the
IN'IDXIMEI'ER Corrpany is produced as designated by the statutes of the
State of Alaska; and
WHEREAS, other units produced do not fulfill the requirerrents
of the City of SelNard Police Departrrent; and
WHEREAS, fOJ::IPal bid solicitation and the drafting of fOJ::IPal
bid docurrents would be both =stly and superfluous; and
WHEREAS, the units are to be purchased by funding provided by
another agency;
NCW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section I. The public interest would best be served by
waiving the bid requirerrents as set forth in Section IO-8 of the City

Code for the purchase of radar and breath-testing equiprrent for the
RIDDI program.
Section 2. The City Manager is hereby authorized to purchase
six KUSTa1 radar units from KUSTa1 Electronics, two radar units from
DECATUR, Inc., and ten breath-testing units from INIOXIMETER, Inc., for
an arrount not to exceed Fourteen Thousand, Five Hundred and Nine and
NO/IOOTHS Dollars ($14,509.00l.
Section 3. This resolution shall take effect inmediately upon
its adoption.
