RESOLUTION NO. 84 -1 0 9
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, TO ACQUIRE PROPERTIES BY CONDEMNATION
WHEREAS, the current and proposed electric power demands of
the City of Seward Utilities District far exceeds the capabilities of
the existing transmission line; and
WHEREAS, the City of Seward Utility District proposes to
include the transmission line to provide the Seward electric customers
better service; and
WHEREAS, the proposed transmission line alignment generally
follows the route of the existing transmission line; and
WHEREAS, the amount of additional property necessary for
transmission line easements is based on engineering of the transmission
line to be the most compatible with the greatest public good and the
least public injury; and
WHEREAS, the City of Seward has reached agreement with most of
the property owners concerning easements for the proposed transmission
line; and
WHEREAS, the City of Seward Utility District has been unable
to reach agreement with several property owners concerning easements for
the proposed transmission line; and
WHEREAS, in order to commence the construction of the proposed
transmission line the City of Seward must acquire easements and commence
construction within the immediate future; and
WHEREAS, AS 29.73.020 grants to a home rule or general law
municipality the power of eminent domain; and
WHEREAS, AS 09.55.420 grants to the City of Seward the power
to obtain the easements within a short period of time by means of filing
with the Condemnation Complaint a Declaration of Taking; and
WHEREAS, the City Council has determined the taking of the
easements by the exercise of the power of eminent domain is therefore in
the public interest and necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Administration is authorized to proceed
with payment to those property owners with whom an agreement has been

reached regarding purchase of proposed transmission line easements.
(See Enclosure "A".)
Section 2. The City Administration is authorized to proceed
with condemnation procedures through the process of eminent domain
against those property owners with whom an agreement has not been
reached for the proposed transmission line easements. (See Enclosure
"B").
Section 3. In the event Declarations of Taking are filed
there shall be deposited in court the amount of money estimated by the
City Council to be just compensation for the easements taken. Those
amounts are based on the highest range of appraisal value as established
by an independent appraiser to be retained by the City.
Section 4. This resolution shall take effect immediately upon
its adoption.
