RESOLUTION NO. 84-115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, GRANTING THE STATE OF ALASKA AN
ACCESS EASEMENT ACROSS CITY PROPERTY FROM
NASH ROAD TO THE LONG TERM CORRECTION
FACILITY SITE
WHEREAS, the City of Seward has through Resolution No. 84-104
deeded property to the State of Alaska for the purpose of constructing a
long term correctional facility; and
WHEREAS, access to this property is across City property; and
WHEREAS, the State of Alaska wishes to include the clearing of
the access road as part of the overall site clearing contract; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY GOUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized and directed
to execute the attached document, which is incorporated herein by
reference, granting the State of Alaska an access easement for highway
purposes and public access.
Section 2. This resolution shall take effect thirty (30) days
following its adoption.

EASEMENT FOR HIGHWAY PURPOSES AND PUBLIC ACCESS
The Grantor, THE CITY OF SEWARD, pursuant to the authority vested
it under statutes and municipal charter, for and in consideration of the
sum of ONE AND NO/100 DOLLAR ($1.00) and other good and valuable consid-
eration in hand paid, conveys unto the Grantee, THE STATE OF ALASKA,
DEAPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES, 411 Aviation
Avenue, Anchorage, Alaska, 99502, a non-exclusive easement for access,
approximately 1,630 feet in length and 60 feet in width in the Seward
Recording District, Seward, Alaska, and more particularly described as
follows:
A 60 foot wide easement for the purpose of access
whose centerline begins at the centerline of the
existing Nash Road at a point which is 30 feet
perpendicular to the north boundary of U. S. Survey
1651, in Section 18, T1S, RIE, S.M., thence easterly
on a line 30 feet measured perpendicular to said
north boundary and parallel to it a distance of
1,630 feet more or less to the easterly boundary of
Fourth of July Creek Tract "E".
This easement to include all lands within the 60
foot width between the Nash Road centerline and the
Tract "E" boundary however skewed.
The easement is depicted on the drawing attached and incorporated
hereto as Exhibit "A".
The easement for the purposes of egress and ingress by Grantee is
subject to the following conditions:
1.
The easement is to be maintained by Grantee and/or its
assigns; Grantor shall not be responsible for mainte-
nance.

2.
Interest in this land shall revert to the City of Seward
if and when it ceases being used for highway purposes and
public access.
3. The easement shall be for highway purposes and public
~ccess to immediately adjoining properties.
IN WITNESS WHEREOF, the Grantor has hereunto set its hand and seal
