HomeMy WebLinkAboutRes1983-026 05/19/83 LH:lm . . . e e CITY OF SEWARD, ALASKA RESOLUTION NO. 83-2~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, SETTING FEES FOR THE SEWARD HUNICIPAL SMALL BOAT HARBOR AND RESCINDING ALL PRIOR RESOLUTIONS IN CONFLICT HEREWITH WHEREAS, Section 5-80.1 of the Seward City Code provides that fees for the use of the Small Boat Harbor are to be set by resolution of the City Council; and WHEREAS, the Harbormaster of the City of Seward has reviewed the current rates charged for moorage in the Small Boat Harbor; and WHEREAS, the Harbormaster has made certain specific recommenda- tions to modify charges for moorage, yard storage, and boat lift fees to more accurately reflect the actual cost of providing those services; and WHEREAS, it is in the public interest to charge users of the Small Boat Harbor for services at a rate reasonably calculated to reflect costs to the City for operation and maintenance of the Harbor; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Fees for the use of the Seward Municipal Small Boat Harbor shall be set as follows: I. MOORAGE FEES A. Moorage Fees, Annual 1. The annual moorage fee for preferential moorage privileges shall be $15. per foot based on the length of the float assigned or the overall length of the vessel (including all hull attachments such as bowspits, davits, dinghies, etc.), whichever is greater. 2. The annual moorage fee for transient moorage pri- vileges shall be the same rate charged for preferential moorage. 3. The six-month rate for either preferential or transient moorage privileges shall be sixty percent (60%) of the applicable annual rate. 4. All moorage privilege fees shall be paid when due and in advance. . . . -- e CITY OF SEWARD, ALASKA RESOLUTION NO. 83-76 Page 2 I. MOORAGE FEES (Cont'd) B. City Dock 1. The City Dock is a working dock and all moorage shall be on the basis of the daily rate established for transient moorage. 2. No vessel shall be permitted to moor to the City Dock in excess of fourteen (14) days without prior written per- mission from the Harbormaster. 3. Cargo loading and unloading shall have priority use of the City Dock at all times. C. Daily Moorage Fees 1. The daily rate for transient moorage, based on the overall length of the vessel (including all hull attachments such as bowspits, dinghies, davits, etc.), or the length of the float used for moorage, whichever is greater, shall be as follows: Length of Vessel or Float Daily Fees Under 19' $ 2.50 19' - 32' 5.00 33' - 45' 7.50 46' - 58' 10.00 59' - 71' 12.50 72' - 84' 15.00 85' - 97' 17.50 98' - 110' 20.00 111 ' - 123' 22.50 124' - 136' 25.00 137' - 149 ' 27.50 150 ' - 162' 30.00 163 ' + 32.50 II. UPLAND STORAGE RENTAL CHARGES Upland storage of boats or boats on trailers or cradles shall be at the rate of $37.50 per boat, trailer or cradle per month. III. BOAT LIFT CHARGES A. A fee of $85. shall be charged for the first hour of use or any portion of time less than one hour. 2. If usage of the boat lift facility does not exceed sixty-six (66) minutes, the fee shall be $85. 3. If usage of the boat lift facility is more than sixty-six (66) minutes but less than seventy-two (72) minutes, the fee shall be $100. 4. If usage of the boat lift facility exceeds seventy- two (72) minutes, the fee shall be $100 plus $8.50 for each six- minute increment or portion thereof of such usage in excess of seventy-two (72) minutes. B. A twenty-five dollar ($25) penalty for leaving the im- mediate area of the City boat yard shall be assessed. . C. City personnel only shall operate the boat lift. D. Vessel owners or agents of any owner desiring to have vessels lifted out of or placed in the water shall sign an ap- plication and make payment of the estimated charges before the work is done. E. No person shall remain on any vessel while it is being removed from or placed in the water. IV. GRID RENTAL CHARGES A. Grid rental rates shall be as follows: First 72 Hours or Portion Thereof Daily Charge Vessels less than 24' in length $ 5.00 Vessels 24' or more but less than 32' 10.00 Vessels 32' or more but less than 45' 20.00 Vessels 45' or more but less than 60' 25.00 Vessels 60' or more but less than 75' 35.00 Vessels 75' and over 50.00 Daily Charges After the First 72 Hours . The Harbormaster shall issue written permission for use of the grid and no boat shall be moored on to the grid until such permission has been granted. The grid use shall be on a first come, first serve, basis. V. SERVICE CHARGE FOR USE OF CITY DOCK FACILITIES A. Service charge is the charge assessed against vessels, their owners, agents or operators, which load or discharge cargo at the City dock, for performing one or more of the following services (subject to sections B-F below): . 1. Providing terminal facilities 2. Arranging berth for vessel 3. Arranging terminal space for cargo 4. Lighting terminal. Service charge shall not apply to the loading and un- loading of fishing gear or equipment or supplies connected with commercial fishing. E. The City of Seward reserves the right and privilege to waive service charges at its discretion when it appears to be in the best interest of the City to do so. . F. Service charge rates apply to cargo loading from or to vessels except as otherwise provided. Service and labor performed by the Harbormaster or any City employee working in the Harbor shall be charged at the rate of one and one-half the hourly wage rate (including fringe bene- fits, overtime and call-out pay) paid to the City employee by the City. B. Pumping of boats which are in danger of sinking shall be charged a rate of ten dollars ($10) per hour, plus any appli- cable labor costs as determined in paragraph (A) of this section. C. All materials or City supplies, including mooring lines, shall be charged at their cost to the City. D. Towing of boats shall be charged at the rate of twenty- five dollars ($25) per boat plus labor charges as determined in paragraph (A) above. VII. BERTHING OF FLOAT PLANES A. be charged Harbor. A fee in the amount of four dollars ($4) per day shall float planes berthing in the confines of the Small Boat VIII. USE OF BOAT FOR PERMANENT LIVING QUARTERS A. A permit must be obtained from the Harbormaster and a fee of twenty dollars ($20) per month or fraction thereof paid for use of a boat for permanent living quarters. Section 2.
