RESOLUTION NO. 85-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING SUPPLEMENTAL AGREEMENT NO. 4
FOR A FOUR-MONTH EXTENSION TO THE SEWARD ARMY TRAVEL CAMP
LEASE OF LOT 3, TRACT A, U.S. SURVEY 242
WHEREAS, the long-term lease agreement with the Army for use
of Lot 3, Tract A, U.S. Survey 242 as an army Travel Camp expired June
30, 1984, and was extended for a six-month and a four-month term under
the same terms and conditions as the original lease; and
WHEREAS, the present lease extension expired April 30, 1985,
and the Department of the Army Corps of Engineers is requesting an
additional four-month extension in order to have time to complete
long-term lease negotiations with the City of Seward; and
WHEREAS, during the course of the long-term negotiations, the
City has been very insistent that the lease value come as close to fair
market value as possible, thus the lease rate is increased to a rate of
Ten Thousand Dollars ($10,000) per annum to be pro rated monthly at
Eight Hundred Thirty-three Dollars ($833), which is a rate near
twenty-five percent (25%) of the fair market value and the same rate
being negotiated for a long-term lease; and
WHEREAS, it is anticipated that the long-term lease can be
negotiated and finalized within the time of this extension; and
WHEREAS, the City Council finds it in the public interest to
accept a less than fair market value in lieu of the on-going long-term
lease negotiations and the positive economic impact made on the com-
munity by the military; and
WHEREAS, the City Council considers this supplemental agree-
ment to be under the provisions of the City Code allowing for a
short-term lease without being subject to the public hearing process;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into
Supplemental Agreement No.4, attached and make a part of this resolu-
tion, to Lease RE-034 with the Department of the Army Corps of Engi-
neers, agents for the U.s. Army.
Section 2. This resolution shall take effect immediately
following its adoption. (The approved lease is subject to suspension
during the first thirty (30) days after passage of the resolution if a
sufficient referendary petition is filed in accordance with Section 4.8
of the City Charter.)

hereinafter called the Lessor, and the UNITED STA TES OF AMERICA, hereinafter called the Government:
WHEREAS, the pcirties hereto desire to amend the above Lease.
NOW TIiEREFORE, these parties for the consideration's hereinafter mentioned covenant and agree that the said
Lease is amended, effective April ,30.1985 . as follows:
Paragraph 3 is amended to del ete the date "30 Apr; 1 1985" and to substitute
therefor the date "31 August 1985".
Paragraph 4, as amended by Supplemental Agreement No. 1 is amended to
delete "TWO BUNDREn DOLLARS ($200.00)" and to substitute therefor the rate
of "TEN THOUSAND DOLLARS ($10,000.00)".

Paragraph 13. is added relating to Supplemental Agreement No.4, "That"this
lease extension is subject to suspension during the first thirty days after
passage of the resolution authorizing said lease extension if .a sufficient
referendary petition is filed in accordance with section 4.8 of the Seward
City Charter."
All other terms and conditions of the lease shall remain in force and effect.
