RESOLUTION NO. 84-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROVING A LEASE AGREEMENT WITH BENTON
GROOM, DBA BADLANDS TOWING & WRECKING, FOR THE OPERATION
OF A VEHICLE STORAGE/IMPOUND FACILITY
WHEREAS, the following described parcel has been utilized as a
vehicle storage and impound area within the City of Seward:
A parcel of land within the Townsite of
Seward, Alaska, upon Lots 17, 18 and 19,
Block 21, more particularly described as
follows:
Commencing at the intersection
of Seventh Avenue and Jefferson
Street as monumented with Road
Monument 6, using N OOOI'30"E to
Road Monument 7 as a Basis of
Bearing, thence, N 17018'14"W,
127.14 feet to The True Point of
Beginning, thence, S 86036'10"W,
115.76 feet to a fence corner,
thence, N 0023'30"W, 70.12 feet
to a fence corner, thence S
0048'35"E, 68.65 feet to The
True Point of Beginning, con-
taining 8,004 square feet, more
or less; and
WHEREAS, Benton Groom, dba Badlands Towing & Wrecking, desires
to obtain a lease to said property in order to conduct a vehicle impound
and storage facility; and
WHEREAS, the terms and conditions of the proposed lease
parallel those terms and conditions set forth in prior leases at the
same location for the same use, making an appraisal of the property
unnecessary; and
WHEREAS, the proposed lease agreement, attached and incor-
porated herein as "Exhibit A", has been reviewed by the City Council and
found to serve the needs of the community; and
WHEREAS, said lease agreement has been the subject of a public
hearing as prescribed in Section 2-87 of the Seward City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. It is in the public interest to sole source lease
Lots 17-19, Block 21, Original Townsite of Seward, to Benton Groom, dba
Badlands Towing & Wrecking, for use as an impoundment facility.
Section 2. In accordance with Section 2-85 of the Seward City
Code, the Council finds that the public interest would best be served by
not obtaining an appraisal of the subject property.
Section 3. The City Manager is directed to proceed with the
finalization of the lease agreement (Exhibit A).
Section 4. This resolution shall take effect 30 days follow-
ing its adoption.
