CITY OF SEWARD, ALASKA RESOLUTION NO. 85-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, SETTING FEES FOR THE SEWARD MUNICIPAL SMALL BOAT HARBOR AND RESCINDING ALL PRIOR RESOLUTIONS IN CONFLICT HEREWITH WHEREAS, Section 5-80.1 of the Seward City Code provides that fees for the use of the Small Boat Harbor are to be set by resolution of the City Council; and WHEREAS, the Harbormaster of the City of Seward has reviewed the current rates charged for moorage in the Small Boat Harbor; and WHEREAS, the Harbormaster has made certain specific recommen- dations to modify charges for moorage, yard storage, and boat lift fees to more accurately reflect the actual cost of providing those services; and WHEREAS, it is in the public interest to charge users of the Small Boat Harbor for services at a rate reasonably calculated to reflect costs to the City for operation and maintenance of the Harbor; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Fees for the use of the Seward Municipal Small Boat Harbor shall be set as follows: I. MOORAGE FEES A. UPLAND STORAGE RENTAL CHARGES Upland storage of boats or boats on trailers or cradles shall be at the rate of Thirty-eight and 65/100 Dollars ($38.65) per boat, trailer or cradle per month. III. BOAT LIFT CHARGES A. The following charges shall be made for use of the boat lift facility: . 1) The fee of Eighty-seven and 55/100 Dollars ($87.55) shall be charged for the first hour of use or any portion of time less than one hour. 2) If usage of the boat lift facility does not exceed sixty-six (66) minutes, the fee shall be Eighty-seven and 55/100 Dollars ($87.55). 3) If usage of the boat lift facility is more than sixty-six (66) minutes but less than seventy-two (72) minutes, the fee shall be One Hundred Three Dollars ($103). 4) If usage of the boat lift facility exceeds seventy-two (72) minutes, the fee shall be One Hundred Three Dollars ($103) plus Eight and 75/100 Dollars ($8.75) for each six minute increment or portion thereof of such usage in excess of seventy-two (72) minutes. The Harbormaster shall issue written permission for use of the grid and no boat shall be moored onto the grid until such permission has been granted. The grid use shall be on a first come, first serve, basis. V. SERVICE CHARGE FOR USE OF CITY DOCK FACILITIES A. A service charge is the charge assessed against vessels, their owners, agents or operators, which load or discharge cargo at the City Dock, for performing one or more of the following services (subject to Section B - F below): 1) Providing terminal facilities 2) Arranging berth for vessel 3) Arranging terminal space for cargo 4) Lighting terminal. -4- . . . . . Service and labor performed by the Harbormaster or any City employee working in the Harbor shall be charged at the rate of one and one-half the hourly wage rate (including fringe benefits, overtime and call-out pay) paid to the City employee by the City. B. Pumping of boats which are in danger of sinking shall be charged a rate of Ten and 30/100 Dollars ($10.30) per hour, plus any applicable labor costs as determined in Paragraph "A" of this Section. C. All material or City supplies, including mooring lines, shall be charged at their cost to the City. D. Towing of boats shall be charged at the rate of Twenty-five and 75/100 Dollars ($25.75) per boat plus labor charges as determined in Paragraph "A" above. -5- . . . . . A fee in the amount of Four and 12/100 Dollars ($4.12) per day shall be charged for float planes berthing in the confines of the Small Boat Harbor. VIII.USE OF BOAT FOR PERMANENT LIVING QUARTERS A. A permit must be obtained from the Harbormaster and a fee of Twenty Dollars and 60/100 ($20.60) per month or fraction thereof paid for use of a boat for permanent living quarters. Section 2. Acceptable methods of payment for Small Boat Harbor services, excluding electric charges, shall include major credit cards. Section 3. The schedule of rates for electric power in the Municipal Small Boat Harbor shall be as follows: 1. $20.08 MONTHLY CUSTOMER CHARGE II. ENERGY CHARGE $.1006/KWH III.
