RESOLUTION NO. 84-75
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, PROVIDING FOR AN ELECTION UPON A
PROPOSED AMENDMENT TO THE CITY CHARTER ALLOWING FOR
THE GRANTING OF FRANCHISES

WHEREAS, the City Council wishes to encourage the planned
growth and economic development of the City of Seward; and
WHEREAS, the Council believes that having the option of
issuing franchises will enhance the City's flexibility in providing for
the growth and development of the City of Seward; and
WHEREAS, franchises that are exclusive or of more than twenty
years duration may be granted only after and if the City Charter is
amended to allow them; and
WHEREAS, Sections 14.2 and 14.3 of the City Charter allow
amendment of the Charter if such an amendment is approved by a majority
of the voters voting in an election considering the amendment;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. For the reasons set forth in the preamble to this
resolution, it is in the best interest of the City of Seward to amend
the City Charter to allow the granting of franchises.
Section 2. Pursuant to Sections 14.2 and 14.3 of the City
Charter, the following proposition will be submitted to the voters at
a special election to be called in accordance with the provisions of
Chapter 8 of the Seward City Code. An affirmative vote of a majority of
those qualified electors voting is required for approval.

Shall the first sentence of Section 13.6 of the Charter of the
City of Seward be amended to read as follows:
Section 13.6 Limitations on the granting of franchises. No
franchise shall be granted without approval of the voters.
Section 3. The foregoing proposition shall be printed on a
ballot which may set forth other propositions, and the proposition set
forth in Section 2 shall be printed in full and the following words
shall be added as appropriate and next a square provided for marking the
ballot:

Section 4. A person may vote at this election who possesses
the qualifications set forth in AS 15.05.010 and who has registered to
vote pursuant to Chapter 7 of Title 15 of the Alaska Statutes (AS
15.07.010, et. seq.). The election shall be conducted in compliance
with the procedures established in Chapter 8 of the Seward City Code.
Section 5. Publication of this resolution shall be made by
posting a copy hereof on the City Hall bulletin board for a period of
thirty (30) days prior to the date of the election. In addition, copies
of the amendment shall be made available at the City Clerk's office for
at least twenty (20) days preceding the date of the election.
