RESOLUTION NO. 95-155
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER
TO EXECUTE A SHORT TERM LEASE WITH KETCHIKAN
PULP COMPANY FOR STORING AND STAGING LOGS AND
APPROVING A RATE ADJUSTMENT FOR LOG WHARFAGE
AT THE SEWARD MARINE INDUSTRIAL CENTER
WHEREAS, Ketchikan Pulp Company (KPC) has made a proposal to lease land at SMIC
for storing and staging beetle-kill logs prior to being loaded at the North Dock and barged to
Ketchikan; and
WHEREAS, KPC has proposed an immediate short term 90-day land lease and a reduced
wharfage rate for this operation; and
WHEREAS, KPC is also interested in developing a long term lease agreement for Parcels
2-3 and 2-4 with a right of first refusal on Parcel 2-5; and
WHEREAS, the City Code authorizes the City Manager to enter into lease agreements of
not more than 120 days without prior Council approval or public hearing; and
WHEREAS, since it is likely that any agreement between the City and KPC will result in
a contract of more than the 120-day Code-allowed short term lease, the City Manager desires to
receive prior authorization from the City Council for the short term lease; and
WHEREAS, only the City Council has the authority to approve special wharfage rates which
differ from those in the published tariff; and
WHEREAS, if this resolution is approved by the City Council, it is the intent of the City
Manager to develop a long term lease agreement for presentation to the Council for public hearing
and action in January;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to enter into a short term lease agreement
not to exceed 120 days between the City and Ketchikan Pulp Company for log storage and staging
on Seward Marine Industrial Center Parcels 2-3 and 2-4.

Section 2. The City Manager is further authorized to execute a wharfage agreement between
the City and Ketchikan Pulp Company adjusting the rate to $0.75 per ton for logs loaded across the
City's marine facilities and staging oflogs adjacent to the North Dock for up to 10 days at no charge.
This wharfage agreement shall be effective until termination of the land lease, or amendment or
termination of the wharfage agreement by the City Council.
Section 3. This resolution shall take effect immediately upon its adoption.
