CITY OF SEWARD, ALASKA RESOLUTION NO. 83-48 e '7U BOOK~PAGE~l{ Seward Recording District , e A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR AN ELECTION UPON A PROPOSED AMENDMENT TO THE CITY CHARTER ALLOWING FOR THE ISSUING OF INDUSTRIAL DEVELOPMENT BONDS INOEXEO WHEREAS, the City Council wishes to encourage the planned growth and economic development of the City of Seward; and WHEREAS, the Council believes that having the option of issuing industrial development bonds for which neither the City nor its taxpayers are financially liable enhances the City's flexibility in providing for the growth and development of the City of Seward; and WHEREAS, industrial development bonds may be issued only after the City Charter has been amended to allow the issuance; and WHEREAS, Sections 14,2 and 14,3 of the City Charter allow amendment of the Charter if such an amendment is approved by a majority of the voters voting in an election considering the amendment; . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1, For the reasons set forth in the preamble to this resolution, it is in the best interest of the City of Seward to amend the City Charter to allow the issuing of industrial development bonds. Section 2. Pursuant to Sections 14,2 and 14,3 of the City Charter, the following proposition will be submitted to the voters at the special election to be conducted October 4, 1983, in conjunction with the regular municipal election scheduled for that same date, An affirmative vote of a majority of those qualified electors voting is required for approval. PROPOSITION NO, Shall the Charter of the City of Seward be amended by adding the following chapter which allows City borrowing by the issuance of industrial development bonds? Chapter 15. Industrial Development Bonds Sec, 15,1 Industrial Development Bonds . Chapter 11 of the Charter shall not apply to any borrowing evidenced by obligations which are industrial development bonds as defined in the Internal Revenue Code, or to any property or inter- est therein constructed, purchased, leased or -1- , . . . e ~OOKRpAGE Y5 Seward Recording Dlstnct ~ CITY OF SEWARD, ALASKA RESOLUTION NO. 83-48 otherwise acquired with the proceeds of the borrow- ing, or to the sale, lease, sublease or other disposition of the property or interest therein, or to contracts with respect to the borrowing or the property or interest therein, provided that the borrowing is not repayable from taxes levied by the City and is not a charge against the general credit or taxing power of the City, The Council shall establish by ordinance the procedures for such borrowing and other matters, Section 3, The foregoing proposition shall be printed on a ballot which may set forth other propositions, and the proposition set forth in Section 2 shall be printed in full and the following words shall be added as appropriate and next a square provided for marking the ballot: PROPOSITION NO. Yes No Section 4, A person may vote at this election who possesses the qualifications set forth in AS 15,05.010 and who has registered to vote pursuant to Chapter 7 of Title 15 of the Alaska Statutes (AS 15,07,010, et. seq,), The election shall be conducted in compliance with the procedures established in Chapter 8 of the Seward City Code, Section 5, Publication of this resolution shall be made by posting a copy hereof on the City Hall bulletin board for a period of four weeks prior to the date of the election. In addition, copies of the amendment shall be made available at the City Clerk's office for at least thirty (30) days preceding the date of the election.
