RESOLUTION NO. 83-64
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, REMOVING THE REVERSIONARY CLAUSE CONTAINED
IN THE QUIT CLAIM DEED ISSUED BY THE CITY OF SEWARD TO THE
KENAI PENINSULA BOROUGH FOR BLOCK 29, ORIGINAL TOWNSITE OF SEWARD
WHEREAS, pursuant to City of Seward Resolution No. 896, dated
February 25, 1974, the City of Seward did deed to the Kenai Peninsula
Borough Block 29 of the Original Townsite of Seward; and
WHEREAS, the quit claim deed issued the Kenai Peninsula
Borough on April 17, 1974, contained a reversionary interest clause
wherein the land and buildings situated thereon would revert to the City
of Seward if and when they ceased to be used for educational purposes;
and
WHEREAS, the quit claim deed issued by the Kenai Peninsula
Borough to the State of Alaska, Department of Education, also contained
this reversionary interest clause; and
WHEREAS, the State of Alaska, Department of Education, is
endeavoring to have constructed on a portion of Block 29 a new student
services building for the Alaska Vocational Technical Center; and
WHEREAS, the facility would be constructed by private firms
and leased to the State of Alaska, Department of Education; and
WHEREAS, the reversionary interest clause contained in the
quit claim deed to the Borough is clouding title to the property to the
extent that private firms are unable to secure commercial loans to
finance construction of the new student service center; and
WHEREAS, the Kenai Peninsula Borough Assembly has removed by
resolution on September 6, 1983, the reversionary interest clause
contained in the Borough's deed to the State of Alaska, Department of
Education; and
WHEREAS, the new student service center will greatly enhance
the Alaska Vocational Technical Center, which Center is an important
asset to Seward;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized and directed to
prepare and file the appropriate legal document releasing the rever-
sionary interest clause contained in the quit claim deed issued the
Kenai Peninsula Borough for Block 29, Original Townsite of Seward, dated

April 17, 1954, and recorded in Book 5, Page 387, Seward Recording
District.
Section 2. This resolution shall take effect immediately upon
its adoption.
