RESOLUTION NO. 83-88
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, REQUESTING THE KENAI PENINSULA BOROUGH
ASSEMBLY AMEND THE BOROUGH ZONING CODE TO PERMIT CONSIDERATION
OF REZONE PETITIONS WHICH SEEK TO BRING A PARCEL INTO CONFORMANCE
WITH THE LAND USE PLAN
WHEREAS, the Kenai Peninsula Borough Assembly has adopted
Title 21, setting forth zoning regulations for the Borough; and
WHEREAS, Section 21.10 of the KPB Code of Ordinances sets
forth zoning ordinance amendment procedures; and
WHEREAS, Section 21.10(c) of the KPB Code provides that no
ordinance altering zoning within the municipal districts shall not be
considered if the area encompassed by the proposed ordinance contains
less than one acre, except for an ordinance altering the boundaries of
existing contiguous zoning districts; and
WHEREAS, this makes it impossible for the Assembly to consider
and act upon zoning petitions not meeting the provisions of Section
21.10(c) of the KPB Code even when such petitions seek to bring the
zoning of a parcel into conformance with the Land Use Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Assembly of the Kenai Peninsula Borough is
hereby requested to amend Section 21.10(c) of the KPB Code of Ordinances
to permit consideration and enactment of zoning changes that would bring
the zoning of a parcel of land into conformance with the Land Use Plan,
not withstanding the fact that such petitions would not meet the other
provisions of this section.
Section 2. This resolution shall take effect immediately upon
its adoption.
