RESOLUTION NO. 83-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AWARDING A CONTRACT FOR THE
LOWELL CREEK TUNNEL RECONSTRUCTION PROJECT.

project (which might itself cause further delay endangering the
public health and safety) the City's consulting engineers
determined that a bid procedure providing for a range of
quantities of Anvil-Top and other unit items would enable the
City to secure the most available protection within the funds
available, and
WHEREAS, the proper installation of Anvil-Top is a
specialized procedure requiring experience and expertise and the
City's engineers have determined that the subcontt'acted position
for installation of Anvil-Top can best be performed by a
particular, specified subcontractor, and
WHEREAS,

Swalling Construction in the amount of ONE MILLION FOUR HUNDRED

($1,464,510.00) .
NOW, THERE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:

Section 1. The contract for the Lowell Creek Tunnel
Reconstruction is hereby awarded to Swalling Construction.
Section 2. The City Manager is authorized to execute a
Notice of Award and other necessary contract documents.
Section 3. The contract hereby awarded is for an
amount not to exceed ONE MILLION FOUR HUNDRED SIXTY-FOUR THOUSAND
FIVE HUNDRED SIXTEEN AND NO/IOO DOLLARS ($1,464,516.00).
Section 4. For the reasons set forth above and In
accordance with Section 10-8(g) of the Seward Code any
irregularities in the bidding procedures are deemed to be
outweighed by the public's health and safety interest in having
the project built as quickly as possible, within available
funding limits, and to the highest possible safety standards.
Section 5. This
