EMERGENCY ORDINANCE 2006-009
AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, SUSPENDING THE SEWARD CITY
CODE CHAPTER 15.20 SIGNS, FOR AN ADDITIONAL 60 DAYS FOR
THE THIRD AVENUE BUSINESSES IMP ACTED BY THE MILE 0-8
ROAD CONSTRUCTION PROJECT
WHEREAS, the State of Alaska Department of Transportation is paving Third Avenue
at the same time a new waterline is being installed in the right-of-way; and
WHEREAS, an emergency exists for the businesses along Third Avenue because their
visibility is lacking, attendance is down, and they and their customers are being unfairly
impacted by these road closures; and
WHEREAS, this ordinance will allow those businesses to continue to advertise during
the short summer season, while preserving the aesthetics of the community; and

WHEREAS, this ordinance does not allow off-premise signs located in the State's right-
of-way or on property owned or controlled by any third-party without the permission of such
party.
WHEREAS, this additional/separate emergency ordinance will expire Friday, October
13, 2006, thus carrying it through until the end of construction for the year; and
WHEREAS, sandwich board signs shall be allowed on utility easements with prior
written permission of the city, and temporary signs shall be allowed, on rights-of-way but not on
utility easements, with prior written permission of the property ownet and/or the city of Seward.
NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF SEWARD
ORDAINS that:
Section 1. The City Council finds and declares that an emergency continues to exist,
because businesses along Third Avenue are adversely affected by the Mile 0-8 road construction
project. The State's road construction is disrupting normal business activities and council finds
it necessary to temporarily suspend the City's sign ordinance for this area to allow Third Avenue
businesses the opportunity to use whatever methods may be available to let customers know they
are open and operating.
Section 2. Council hereby temporarily suspends the application of Seward City Code
15.20 for businesses along Third Avenue for an additional 60 days and finds this action to be
__ necessary for preserving the welfare of the local businesses.

Section 3. Sandwich board signs shall be allowed on utility easements with prior written
permission of the city, and temporary signs shall be allowed, on rights-of-way but not on utility
easements, with prior written permission of the property owner and/or the city of Seward.
Section 4. This emergency ordinance shall take effect immediately upon enactment and
shall remain in effect for sixty days from the date of its enactment.
