Commission Introduction Date: 5/23/05 Public Hearing Date: 6/13/05 Enactment Date: 6/13/05 CITY OF SEWARD, ALASKA ORDINANCE NO. 2005-03 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE ZONING FROM SINGLE FAMILY RESIDENTIAL (R1) TO RURAL RESIDENTIAL (RR) FOR THE FOURTEEN (14) LOTS IN AFOGNAK ACRES SUBDIVISION NO.1 AND A PORTION OF THE AREA WHICH IS LOCATED NORTH OF THE AFOGNAK ACRES SUBDIVISION NO. 1 AND EAST OF THE WEST BOUNDARY OF THE JAPANESE CREEK LEVEE EASEMENT LINE WITHIN A PORTION OF SECTION 33, GOVERNMENT LOT 1 AND THE NE y.. OF THE NE y.. SECTION, TOWNSHIP 1 NORTH, RANGE 1 WEST, SEWARD MERIDIAN .... WHEREAS, an applicant has requested a rezone of the fourteen lots in Afognak Acres Subdivision No.1 (preliminary plat) from Single Family Residential (Rl) to Rural Residential (RR) and a portion of the area located North of the Afognak Acres Subdivision No.1 and East of the West boundary of the Japanese Creek levee easement line within a portion of Section 33, Government Lot 1 and the NE 14 of the NE 14 Section, Township 1 North, Range 1 West, Seward Meridian; and WHEREAS, the larger minimum lot sizes and rural lifestyle options in the Rural Residential zoning district promote a quiet neighborhood; and WHEREAS, promoting low density development in this area will lessen the amount of traffic in the adjoining Rural Residential area and will cause less wear on the roads; and WHEREAS, having the opportunity to build homes on lots with larger lot sizes in a low-density neighborhood will encourage that type of development to stay within City limits; and WHEREAS, this rezone is not being made in order to benefit any particular individual or select group of individuals representing any particular special interests. Rezoning these properties will be beneficial to the neighborhood and to the community at large; and ... WHEREAS, the properties to the East are zoned Rural Residential, properties to the West are Resource Management, properties to the North are Resource Management and the properties to the South are Single Family Residential; and City of Seward Ordinance No. 2005-03 Page 2 WHEREAS, the current land use map designation for these lots is Single Family Residential (Rl); and WHEREAS, changing the zoning to Rural Residential is consistent with Land Use Goals in both the Comprehensive and Strategic Plans; and WHEREAS, the official maps described in SCC 15.01.030 will have to be amended from Single Family Residential (Rl) to Rural Residential (RR) in response to this zoning change and change of land use map; and WHEREAS, the Planning & Zoning Commission has complied with public notice and hearing procedures for amending zoning and land use district designations, as required by Title 15; and WHEREAS, at their February 1 sl and March 4th, 2005 meetings, the Planning and Zoning Commission reviewed the applications, held public hearings and recommended City Council approval of the proposed zoning amendment included in this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: .. . I ~ s . Section 1. The official Land Use map ofthe City is hereby amended by changing the land use designation of the lots as displayed in Exhibit A attached hereto Single Family Residential (Rl) to Rural Residential (RR). Section 2. The official Zoning Map of the City is hereby amended by changing the zoning designation of Lots 1 through 14, Afognak Acres Subdivision No.1 and a portion of the area located North of the Afognak Acres Subdivision No.1 and East of the West boundary of the Japanese Creek levee easement line within a portion of Section 33, Government Lot 1 and the NE lf4 of the NE lf4 Section, Township 1 North, Range 1 West, Seward Meridian from Single Family Residential (Rl) to Rural Residential (RR) as shown on Exhibit B attached hereto.
