A RESOLUTION BY THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A
CONDITIONAL USE PERMIT TO THE CITY OF SEWARD TO
CONSTRUCT AND MANAGE THE OPERATION OF THE LONG TERM
CARE FACILITY ON FOREST ACRES TRACT A, SEWARD LONG
TERM CARE FACILITY SUBDIVISION, FOREST ACRES ADDITION
(pRELIMINARY PLAT), IN THE INSTITUTIONAL ZONING DISTRICT
WHEREAS, the City of Seward has applied for a conditional use permit from the
Seward Planning and Zoning Commission to construct and manage the operation of the
community Long Term Care (LTC) Facility on Forest Acres, Tract A, Seward Long Term Care
Facility Subdivision, Forest Acres Addition (preliminary Plat); and
WHEREAS, at the September 5, 2006 Planning and Zoning meeting the Commission
supported and recommended to Seward City Council the zoning and Land Use Map amendment
to change Forest Acres, Tract A from Rural Residential and Resource Management to
Institutional zoning; and
WHEREAS, although the Greenhouse facility requires Institutional zoned property, the
philosophy and housing facilities are truly residential in nature; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225,
facilities such as the planned LTC development are allowed in the Institutional Zoning District as
a conditionally permitted use; and
WHEREAS, the intent is to provide a true residential neighborhood by clustering the
housing units and providing landscape buffers to the roads adjacent to residential zones; and
WHEREAS, this facility will be comprised of four (4) single story homes and a single
story 'commons' building to provide support to the homes with the possibility of adding
additional homes in the future; and
WHEREAS, on January 9, 2006, by Resolution 2006-71, Seward City Council endorsed
Seward's Long-term care facility as an official Green House@ project and on July 26,2006 by
Council Resolution 2006-23 selected a final site layout; and
WHEREAS, the homes themselves are essentially luxury homes with well groomed
surroundings that will do nothing but add value to the surrounding neighborhood; and

WHEREAS, having complied with the public notification process, on September 5,
2006, the Seward Planning and Zoning Commission held the required public hearing on the
Conditional Use Permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC 15.l0.320.D., the Commission shall establish a finding that the
use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and
the purposes of the zoning district.
Finding: This finding is currently in the public process of being met. The property
is currently zoned Rural Residential (RR) and Resource Management (RM); however an
Ordinance amending the current zoning to Institutional (INS) is scheduled before the
Seward City Council for introduction September 25, 2006 and adoption on October 9,
2006. The Institutional Zoning district provides an area for public and private health care
uses (SCC 15.05.025. (b) (11). Operating a long-term care facility is consistent with the
planned uses in the Institutional Zoning District.
B. The value of adjoining property will not be signifICantly impaired
Finding: This finding has been met. Forest Acres, Tract A, is a large 27.5 acre
parcel located to the north of the Forest Acres residential subdivision. The planned
facilities are residential in nature, consisting of four (4) single story homes and a single
story commons building. These facilities are essentially luxury homes with well-
groomed surroundings. There is no indication that the proposed facility would negatively
impair the value of adjoining property.
C. The proposed use is in harmony with the Seward Comprehensive Plan.
Finding: This rmding has been met. The relocation of the LTC facility is in
harmony with the Seward 2020 Comprehensive Plan (approved by Council, 2005) and
Strategic Plan (1999) in that both plans encourage growth and relocation of the LTC
facility and health care needs of the community.

The Comprehensive Plan states "Relocate the long-term care facility and the hospital to a site
which will support expansion and modernization." (page 27).

The Strategic Plan states "We are a community that provides an integrated array of health care
services designed to protect and improve the quality of life for all citizens". (page 19)
D. Public Services andfacilities are adequate to serve the proposed use.
Finding: This finding shall be met. Tract A is currently a large undeveloped parcel
with no infrastructure. The required infrastructures planned for this development project
will not only serve the new LTC facility but also will also provided improvement to the
surrounding neighborhood.
All public utility easements required onsite shall be provided by recorded document and
there shall not be any encroachments, above or below ground, in the utility easements.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: This finding shall be met. The campus and facility will benefit the
community in public safety, health, and welfare. This is the very nature of the facility.
There is no reason to believe that the LTC facility would increase crime in the
neighborhood; the campus shall be trash free with well-groomed and maintained grounds,
and noise pollution should be non-existent. Extensive planning and study have gone into
the planned traffic routes to and from the facility and it is believed that the LTC facility
will have minimal traffic impacts to the surrounding neighborhood. There is more than
ample parking planned for the facility and plenty of additional land available for future
needs.
F. Any and all specifIC conditions deemed necessary by the commission to fulfill the
above-mentioned conditions shall be met by the applicant. These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
1. Modifications to the site plan dated August 24,2006 which was approved by the
Commission as a supporting document for this Conditional Use Permit shall be
approved by staff or the Commission prior to implementation.
2. Modification to the final approval of this conditional use permit may, upon
application by the permitee, be modified by the Planning and Zoning
Commission:
A When changed conditions cause the conditional use to no longer conform to
the standards for its approval.
B. To implement a different development plan conforming to the standards for its
approval.
C. The modification plan shall be subject to a public hearing and a filing fee set
by City Council Resolution.

Section 2. The Planning and Zoning Commission finds that the proposed use, subject to the
above conditions satisfies the criteria for granting a conditional use permit provided the
conditions listed on Section 1, Subsection F are met by the applicant, and authorizes the
administration to issue a conditional use permit to the City of Seward to allow the construction
and manage the operation of the Seward Long Term Care facility on Forest Acres, Tract A
Forest Acres Addition (preliminary plat) subject to the above conditions.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320,
Conditional use permits, and authorizes the administration to issue a conditional use permit.
Additionally, the administration shall periodically confirm the use conforms to the standards of
its approval.
Section 4.
This resolution shall take effect 10 days following its adoption.

BACKGROUND & JUSTIFICATION:
The City of Seward has applied for a Conditional Use Permit (CUP) to construct and manage the
operation of the community Long Term Care (LTC) facility on Forest Acres Tract A, Long Term
Care Facility Subdivision, Forest Acres Addition (Preliminary Plat), in the Institutional Zoning
District. The vast majority of the property is currently zoned Rural Residential with Lots A V,
A W, CK, CL, and the northern third of the levee easement area zoned Resource Management.
However a Land Use Map and Rezone Ordinance amending the zoning from Rural Residential
and Resource Management to Institutional is on the City Council agenda for introduction on
September 25,2006 and planned for adoption on October 9, 2006.
SURROUNDING LAND USE AND ZONING:
The proposed development site is surrounded by Rural Residential zoning to the South and East.
The area to the West and North is Resource Management zoning. The Rural Residential areas to
the South and East are designed for larger lots and single-family homes. Resource Management
areas to the North and West are generally large undeveloped areas with no public services or
utilities.
On January 9,2006, by Resolution 2006-71, Seward City Council endorsed Seward's Long-term
care facility as an official Green House@ project. On July 26, 2006 the Seward City Council by
Resolution 2006-83 directed the City Manager to proceed with the acquisition of the parcel now
proposed as Tract A to provide land for the development of the community's LTC facility and
other healthcare expansion opportunities, subject to bond fmancing.
As required by Seward City Code, property owners within three hundred (300) feet of Tract A,
and in addition, all local property owners who use the Forest Acres road network, were notified
of the proposed Conditional Use Permit action in order to provide more opportunity for public
involvement and the property was posted with public notice signs.

The City of Seward is coming before the Planning and Zoning Commission regarding the
development of the Long Term Care Facility on 25 acres in the Forest Acres Subdivision The
acres include lots A W, A V, AX, A Y, BA, AZ, BCl, BC2, BDl, BD2, CL, CK, CM, CJ, CN, CI,
CO, CH, CPl, CP2, CGl, CG2, Tract A, Lots 15, 16, 17,18, 19,20,21.
The site will be the home of Seward's new Long Term Care Facility and be utilized for future
expansion of similar facilities
The property is needed to incorporate the new Green House@ concept in long term care into the
new site. The crux of the Green House@ concept is centered on developing a 'home'
environment which begins in developing a campus. The intent is to provide a true residential
neighborhood by clustering the housing units and providing landscape buffers to the surrounding
roads. This facility will comprise of 4 single story homes and a single story 'commons' building
to provide support to the homes. Each home will accommodate 10 residents.
The houses shall incorporate all the amenities of home, including private bedrooms, private
bathrooms, community living room (Hearth), kitchen, dining, personal laundry room, exterior
living space (patio) and other support spaces as storage and pantry. Other areas are provided to
accommodate services to the residents, including Physical Therapy, Office, Soiled Room and
Clean Supply. The design of the house locates the kitchen as the center point of the house to
allow the staff member to observe the Front Door, Hearth, Dining and the exterior patio. The
service areas are located to accommodate easy access from the kitchen by the staff, but
discourage access by the residents.
This is a 180 degree turn from the past conventional methodology in long term care. This new
approach is extremely effective in providing our elderly with the best care possible. This facility
will be the first Greenhouse@ in the state of Alaska and will most definitely be a model for other
facilities in the state.
On January 9th, 2006 Seward City Council endorsed Seward's Long-term care facility as an
official Green House@ project and on July 26, 2004 City Council through Resolution 2006-83
also endorsed the final site layout.

Although the Greenhouse facility requires Institutional zoned property, the philosophy and
facilities are truly residential in nature. Its residents need to be included as part of the
surrounding neighborhoods and welcomed into the community. The homes themselves are
essentially luxury homes with well groomed surroundings that will do nothing but add value to
the surrounding neighborhood.
Infrastructure improvements to the surrounding neighborhood will be made available such as: 1.
New water service along parts of Mognak Ave, Cottonwood, and Oak Street, 2. New sewer
along the northern end of Maple from Ash to Dimond, 3. Road upgrades for Cottonwood; Maple,
from Ash to Dimond; and the northern part of Afognak Ave. 4. The site requires 3 phase electric
power which be brought to the site as well.
All services will be sized appropriately to accommodate the LTC facility now and will be design
to accommodate similar future facilities.
The campus and facility naturally will benefit public safety, health, and welfare. This is the very
nature of the facility. This is a health care facility: Crime should be nonexistent; the campus
should be trash free, noise pollution should be non existent, and there should be minimal traffic
impacts. There are many, many benefits of having this facility as part of the residential
neighborhood.
