HomeMy WebLinkAboutRes2007-053 L L L Sponsored by: Oates CITY OF SEWARD, ALASKA RESOLUTION 2007-053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH TIMERLINE EXCAVATING, INCORPORATED FOR AN AMOUNT NOT-TO-EXCEED $77,850.00 TO REMOVE APPROXIMA TEL Y 15,000 CUBIC YARDS OF DEBRIS AT THE LOWELL CREEK WATERFALL WHEREAS, approximately 15,000 cubic yards of gravel debris is a direct result of the /lood that occurred October 6, 2006; and WHEREAS, due to the proximity of critical City owned infrastructure such as a primary sewage lift station, Sealife Center fresh water pump house and the Shell Fish Hatchery to the Lowell Creek Waterfall, removal of this excess debris is a high priority; and WHEREAS, in an effort to protect City infrastructure from the possibility of another /lood event at the Lowell Creek Waterfall, this dcbris removal project has been added to the FEMA Project Worksheet; and WHEREAS, under State construction grants regulations (18 AAC73.020 (f)) a construction contract must go to the lowest responsive, responsible bidder unless the Department waives the requirement; and WHEREAS, the City ofScward will be reimbursed by FEMA for the costs of removing this debris if we are in accordance with State regulations (18AAC73.020(f)). NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is hereby authorized to enter into an agreement, in substantial form on behalf of the City as attached, with Timberline Excavating, Incorporated for an amount not- to- exceed $77,850.00 for the removal of flood debris from the Lowell Creek Waterfall. Section 2. lfthe City is in compliance with State regulations (I 8AAC 73. 020 (f)), the City of Seward will be reimbursed by FEMA upon completion and submittal of appropriate documentation. Section 3. This resolution will take effect immediately upon its adoption. Casey, Public Works Director Agenda Item: Lowell Creek Debris Removal BACKGROUND & JUSTIFICATION: The Lowell Creek Outfall has in excess of 15,000 cubic yards of debris (gravel) that needs to be removed. The deposition of material is a result of the October 9, 2006 flooding event. City staff, in an effort to mitigate the immediate threat of another extreme flood event, included the Lowell Creek Outfall debris removal in our Project Worksheets. Debris (gravel) that is not removed, prior to another flood event, may compromise the City’s ability to protect critical infrastructure in the outfall vicinity. Those critical pieces of infrastructure include the City owned Shellfish Hatchery, the City’s primary sewage lift station and the City owned SeaLife Center fresh water pump house (newly constructed-post flood). Any compromise of these structures could have grave operational and/ or environmental consequences. Staff developed a general scope of work and issued an invitation to bid for the removal of the debris on April 17, 2007. Four bids were received on, or before, the May 4, 2007 deadline. All bid submittals were complete and all bidders were considered responsive and responsible. Seward City Code 6.10.230 may allow preference to be given to local bidders if their bid is within the lesser of $5,000 or five percent of each other. However, Federal Regulations for this type of grant prohibit the use of statutorily or administratively imposed in-State or local geographical preferences in the evaluation of bid or proposals except in those cases where applicable Federal statutes expressly mandate or encourage geographic preference. Since those mandates do not exist, local preference was not part of the invitation to bid. The lowest bidder for the debris removal is Timberline Excavating, Incorporated @ $5.19 per cubic yard. CONSISTENCY CHECKLIST : Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures. FISCAL NOTE: The City of Seward will be reimbursed for the removal costs by FEMA upon completion of the project and at such time as the City of Seward submits the appropriate documentation. Account coding for this project is 866-8622-5390.
