RESOLUTION 2005-61
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROVING THE LEASING OF FIVE (5) CITY-
OWNED PARCELS FOR USE AS A RACETRACK IN ACCORDANCE
WITH THE SEWARD CITY CODE, SECTION 15.10.130, AS AN
UNLISTED USE
WHEREAS, the Seward Racing Lions Club has applied for the use of five (5) parcels of
City-owned land located at the Seward Marine Industrial Center (SMIC) for use as a racetrack; and
WHEREAS, this matter has been considered at length by the City's Planning and Zoning
Commission, which made its recommendation to the City Council on May 4,2005, in Planning and
Zoning Commission Resolution 2005-13, that these five (5) parcels be leased to the Seward Racing
Lions Club for use as a racetrack in accordance with Seward City Code, Section 15.10.130, as an
unlisted use; and
WHEREAS, the parcels have a total size of approximately 12.26 acres and all the parcels are
at the present time vacant and undeveloped; and

WHEREAS, City staff and others have identified, discussed and evaluated a number of
alternative sites for a racetrack; and
WHEREAS, having an established racetrack in Seward will enhance the community by
providing opportunities for enjoyment and participation in motor sports and will provide an
additional winter recreational activity which may attract winter tourists to the Seward area; and
WHEREAS, it is in the public interest to establish a racetrack in an area where that activity
is compatible with surrounding land uses and to provide reasonable restrictions on the racetrack's
design, operation and maintenance; and
WHEREAS, the City Council has heard considerable public input, weighed that input and
decided that the racetrack location which was recommended by Planning and Zoning Commission
Resolution 2005-13 is the best available site for such a racetrack.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. The City Council of the City of Seward, Alaska hereby selects the site described
below and marked on the accompanying map as the site for the racetrack to be developed by the
Seward Racing Lions Club.
Fourth of July Creek Subdivision, Seward Marine Industrial Center (SMIC),
unsubdivided remainder of Block 6; Fourth of July Creek Subdivision, SMIC
Addition No.1, Lot 2, Block 6; Fourth of July Creek Subdivision, SMIC Addition
No.1, Lot 3, Block 6; and Fourth of July Creek Subdivision, SMIC, Lot 1 Block 6.
Section 2. The City Council hereby authorizes and instructs the City Manager to lease the
above-described property to the Seward Racing Lions Club at such minimal lease fee as the City
Manager deems appropriate and to impose such terms and conditions upon the design, construction,
operation and maintenance ofthe racetrack as the City Manager finds to be reasonable and necessary
for the protection ofthe City of Seward, its residents, and participants and spectators at the racetrack.
Section 3. This resolution shall be effective thirty (30) days after passage and posting.

Agenda Item:________Leasing five (5) parcels at SMIC for a racetrack
BACKGROUND & JUSTIFICATION:
More than a year ago, the Seward Racing Lions asked to lease land in the
Seward Marine Industrial Center (SMIC) area for use as a racetrack. On May
4, 2005, the Seward Planning and Zoning Commission passed Resolution
2005-13, recommending that five (5) parcels be leased to the Seward Racing
Lions Club for use as a racetrack in accordance with the Seward City Code,
Section 15.10.130, as an unlisted use.
The parcels have a total size of approximately 12.26 acres. All the parcels are
vacant and undeveloped.
The City has held a public hearing about this matter. At that hearing, there
was generally support for the establishment of a racetrack. A few expressed
concerns about the proposed location being too close to the Spring Creek
Correction Center.
The Seward Racing Lions Club has invested considerable time and effort over a
period spanning nearly two years to work within the system and bring this
matter before the City Council. The Lions Club has patiently worked its way
through all required steps and is ready for the Council to take action.

RECOMMENDATION:
City Council approve this Resolution and direct the City Manager to lease the
five (5) lots described to the Seward Racing Lions Club at a minimal lease fee,
the amount of which should be determined by the City Manager, and further
that the City Council direct the City Manager to impose all terms and
conditions he deems necessary upon the design, construction, operation and
maintenance of the racetrack, in order to ensure that the City of Seward, the
City’s residents, and participants and spectators at the racetrack are adequately
protected. Such terms and conditions may be in the lease itself, in separate
documents, or both, as the City Manager deems appropriate.
