ORDINANCE 2002-11
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE CITY OF SEWARD CODE, CHAPTER 12.05,
CODES OF TECHNICAL REGULATION, REPEALING THE UNIFORM
MECHANICAL CODE, AND ADOPTING THE 2000 EDITION OF THE
INTERNATIONAL MECHANICAL CODE (IMC), INCLUDING REVISIONS
WHEREAS, as of September 15,2001, the State of Alaska has adopted the 2000 Edition of
the International Mechanical Code (IMe); and,
WHEREAS, the City of Seward is required to adopt a code at least as restrictive as that
which the State adopts; and,
WHEREAS, the City of Seward has included the State of Alaska amendments to the IMC,
and additional amendments to modifY the code for Seward climatic conditions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS, THAT:
Section 1 The Seward City Code, Section 12.05.030, Uniform Mechanical Code, is
hereby repealed effective January 1, 2003.
Section 2 The Seward City Code, Chapter 12.05, Codes of Technical Regulation, is
hereby amended by adding of Section, to be numbered 12.05.031, effective January 1, 2003, which
Section reads as follows:
12.05.031
International Mechanical Code Adopted.
A.
The International Mechanical Code, International Mechanical Code, Chapters
1-15 and Appendix A, 2000 Edition, as on file with the City Clerk, approved
and published by the International Code Council (Consisting ofthe Building
Officials Code Administrators (BOCA); the International Conference of
Building Officials (ICBO), and the Southern Building Code Congress
International, Inc.(SBCCI)), is hereby designated and shall be known as the
Seward mechanical code and shall constitute the laws of the city relating to
installation and maintenance of heating, ventilation, cooling, and refrigeration
systems. Although not published in full in this section, all of the provisions
of the International Mechanical Code Chapters 1-15 and Appendix A, 2000
Edition, except as provided in subsection D. ofthis section, shall be and are
hereby adopted by reference to the same extent as if set forth in full in this
section, except to the extent that the International Mechanical Code shall be

in conflict with this code or any relevant ordinance later adopted, in which
case the provisions ofthis code shall prevail.
B. The City of Seward shall possess three copies of the city designated edition of
the International Mechanical Code, for public use, inspection and
examination, so long as the provisions thereof remain in force.
C. The International Mechanical Code, shall regulate all occupancies and
buildings in the City of Seward. It shall be unlawful for any person to erect,
construct, enlarge, alter, repair, move, remove, improve, convert, demolish,
or equip any building or structure in the city, or cause or permit the same to
be done, contrary to or in violation of any of the provisions of the Interna-
tional Mechanical Code adopted and incorporated as the Seward mechanical
building code by this section.
D. The International Mechanical Code (LM.C.) 2000 Edition, adopted in
Subsection A of this section, is hereby amended by adopting the following
revisions and exceptions to the code:
(1) Chapter 1 of the LM.C. is revised by deleting Sections 103, 104, and 106 - 109;
(2) Chapter 1, Subsection 101.2 of the IM.C., is revised by deleting the reference
"International Fuel Gas Code" and replacing it with "Unifonn Plumbing Code as
adopted by 8 AAC 63.010. as amended as ofNovembcr 1 L 2000 and as amended
from time to time";
(3) Chapter 2, Subsection 201.3 ofthe 1M c.., is revised by deleting the reference "ICC
Electrical Code" and replacing it with "National Electrical Code as adopted by 8
AAC 70.025. as amended as of December 17. 1999 and as amended from time to
time";
(4) Chapter 2, Subsection 201.3 of the IM.C., is revised by deleting the references
"International Fuel Gas Code" and "International Plumbing Code" and replacing
them with "Uniform Plumbing Code as adopted by 8 AAC 63.010. as amended as of
November 1 L 2000 and as amended from time to timc";

(5) Chapter 3, Subsection 301.2, first sentence of the I.M.e., is revised by deleting the
words "in accordance with the International Energy Conservation Code ";
(6) Chapter 3, Subsection 301.3 of the I.M.e., is revised by deleting the reference
"International Fuel Gas Code" and replacing it with "Uniform Plumbing Code as
adopted by 8 AAC 63.010. as amended as ofNovembcr 1 L 2000 and as amended
from time to time";
(7) Chapter 3, Subsection 301.7 ofthe I.M. e., is revised by deleting the reference "ICC
Electrical Code" and replacing it with "National Elcctrical Code as adopted by 8
AAC 70.025, as amended as of December 17, 1999 and as anlended from time to
time";
(8) Chapter 3, Subsection 301.8 of the I.M.e., is revised by deleting the reference
"International Plumbing Code" and replacing it with "Unifornl Plumbing Code as
adopted by 8 AAC 63.01 O. as amended as of November 11, 2000 and as amcndcd
from time to time";

Chapter 3, Subsection 303.3 Exception 3, second sentence of the 1M. e., is revised by
deleting the words "of the International Energy Conservation Code";
(10) Chapter 3, Subsection 304.7 of the I.M. e., is revised to read: "Clearances to
combustible construction. Heat-producing equipment and appliances must be
installed to maintain the required clearances to combustible construction as specified
in the listing and manufacturer's instructions. These clearances may be reduced only
in accordance with Section 308 of the I.M.e. Certain unlisted, heat-producing
equipment shall be allowed ifthe clearances to combustible construction specified in
Table 304.7 ofthis Code. Clearances to combustibles must include considerations
as door swing, drawer pull, overhead projections or shelving and window swing,
shutters, coverings, and drapes. Devices such as doorstops or limits, closers, drapery
ties, or guards, may not be used to provide the required clearances.";
(11) Chapter 3, Subsection 304.7 of the I.M. e., is revised by adding Table 304.7 to read:

Footnotes:
(1) The minimum dimension shall be that necessary for servicing the appliance, including
access for cleaning and normal care, tube removal, and similar items.
(2) The dimension may be six inches (152 mm) for an automatically stoker-fired forced-warm-
air furnace equipped with 250 degree Fahrenheit limit control and with barometric draft
control operated by draft intensity and permanently set to limit draft to a mazimum intensity
ofO.13-inch water gauge (32 Pa).
(3) Approved appliances must be installed on non-combustible floors and may be installed on
protected combustible floors. Heating appliances approved for installation on protected
combustible flooring shall be so constructed that flame and hot gases do not come in contact
with the appliance base. Protection for combustible floors shall consist of four inch (102
mm) hollow masonry covered with sheet metal at least 0.021 inch (0.05 mm) thick (NO. 24
manufacturers standard gauge). Masonry must be permanently fastened in place in an
approved manner with the ends unsealed and joints matched so as to provide free circulation
of air through the masonry. Floor protection shall extend 12 inches (305 mm) at the sides
and rear of the appliance, except that at least 18 inches (457 mm) shall be required on the
appliance-opening side or sides measured horizontally from the edges ofthe opening.
(4) The 48-inch (1219 mm) clearance maybe reduced to 16 inches (914 mm) when protection
equivalent to that provided by items 1 through 6 of Table 304.7 is applied to the combustible
construction.
(5) Clearance above the charging door must be at least 48 inches (1219 mm).

(6) If the appliance is encased in brick, the 18-inch (457 mm) clearance above and at sides and
rear may be reduced to 12 inches ((305 mm).";
(12) Chapter 3, Section 312.2, first sentence oftheJ.M.C, is revised by deleting the words
"using the design parameters specified in Chapter 3 of the International Energy
Conservation Code ";
(13) Chapter 4, Subsection 403.3, first sentence of the J.M.C, is revised to read:
"Ventilation systems must be designed to have the capacity to supply the minimum
outdoor airflow rate required in Table 403.3 based on the occupancy ofthe space and
the occupant load or other parameter as stated herein, or in accordance with the
American Society of Heating. Refrigeration and Air Conditioning Engineeers
(ASHRAm Standard 62 (1999 Edition) as adopted by reference.";
(14) Chapter 5, Section 513 of the J.M.C, is revised by deleting the reference "ICC
Electrical eode" and replacing it with "National Electrical Code as adopted by 8
AAC 70.025, as amended as of December 17,1999 and as amended from time to
time";
(15) Chapter 6, Subsection 603.8, first sentence of the J.M.c., is revised by deleting the
words "in accordance with the International Energy Conservation Code ";
(16) Chapter 6, Subsection 604.1, first sentence of the J.M. C, is revised by deleting the
words "and the International Energy Conservation Code";
(17) Chapter 7, Subsection 701.1, second sentence ofthe J.M. C, is revised to read: "The
requirements for combustion and dilution air lur gas-fired appliances shall be in
accordance with Section 304 of the International Fuel Gas Code, 2000 Edition as
adopted by reference.";
(18) Chapter 7, Subsection 709.1 of the J.M. C, is revised by adding a second sentence to
read: "Combustion-air openings must be covered with corrosion-resistant screen of
no greater than one inch (13 mm) mesh.";
(19) Chapter 8, Subsection 801.1 of the J.M. C, is revised by deleting the reference
"International Fuel Gas Code" and replacing it with "Uniform Plumbing Code as
adopted by 8 AAC 63.010, as amended as of November 11, 2000 and as anlended

(20) Chapter 9, Subsections 901.1 and 906.1 of the I.M. c., are revised by deleting the
reference "International Fuel Gas Code" and replacing it with "Uniform Plumbing
Code as adopted by 8 AAC 63.(HO, as amended as of November 11,2000 and as
anlended from time to time";
(21) Chapter 9, Subsection 908.5 of the I.M.c., is revised by deleting the reference
"International Fuel Gas Code" and replacing it with "Uniform Plumbing Code as
adopted by 8 AAC 63.010, as amended as of November I L 2000 and as amended
from time to time";
(22) Chapter 9 oftheI.M.C., is revised by the addition of Section 925 to read: SECTION
925. UNVENTED ROOM HEATERS.
925.1 General. Unvented room heaters shall be tested in accordance with American
National Standards Institute (ANSI) 221.11.2 (1996 Edition), adopted by reference
and may be installed in accordance with the conditions of the listing and the
manufacturer's installation instructions.
925.2 Prohibited use. One or more unvented room heaters may not be used as the
sole source of comfort heating in a dwelling unit.
925.3 Input rating. Unvented room heaters may not have an input rating in excess
of 40,000 Btulh (11.7 kW).
925.4 Prohibited locations. Unvented room heaters may not be installed within
Group A, E, or I Occupancies. These appliances may not be located in, or obtain
combustion air from, any of the following rooms or spaces:
(1) Sleeping Rooms;
(2) Bathrooms;
(3) Toilet rooms;
(4) Storage closets;
(5) Surgical rooms.
Exceptions:
(1)

bathroom provided the input rating does not exceed 6000 Btu
per hour (1.76 kW) and the bathroom is not a confined space.
(2) A single wall-mounted unvented room heater equipped with
and oxygen depletion safety shutoff system and installed in a
bedroom if the input rating does not exceed 10,000 Btu per
hour (2.93 kW) and the bedroom is not a confined space.
925.4 Room or Space volume. The aggregate input rating of all unvented appliances
installed in a room or space may not exceed 20 Btu/h per cubic foot of volume ofthe
room or space. Where the room or space in which the equipment is installed is
directly connected to another room or space by a doorway, archway, or other opening
of comparable size that cannot be closed, the volume of such adjacent room or space
may be permitted to be included in the calculations.
925.6 Oxygen-depletion safety system. Unvented room heaters shall be equipped
with an oxygen-depletion-sensitive safety shutoff system. The system shall shut off
the gas supply to the main and pilot burners when the oxygen in the surrounding
atmosphere is depleted to the percent concentration specified by the manufacturer,
but not lower than 18 percent. The system may not incorporate field adjustment
means capable of changing the set point at which the system acts to shut offthe gas
supply to the room heater.
925.7 Unvented log heaters. An unvented log heater may not be installed in a
factory-built fireplace unless the fireplace system has been specifically tested, listed,
and labeled for the use in accordance with Underwriters Laboratories (UL) 127.";
(13) Chapter 10, Subsection 1001.1 of the I.MC, is revised to read: "Scope. This
chapter govcrns the installation, altcration. and repair of boilers, water heatcrs, and
pressure vessels not subiect to the provisions of the Department of Labor and
Workforce Development under AS 18.60.80 - 18.60.395.";
(14) Chapter 10 ofthe I.M C, is revised by deleting the reference "International Plumbing
Code" and replacing it with the reference "Uniform Plumbing Code as adopted by 8
AAC 63.010, as amended as of November 11, 20DO and as amendcd from timc to
time";
(15) Chapter 10 of the I.MC, is revised by deleting Section 1011;
(16) Chapter 11, Subsection 1101.4 of the I.M C, is revised by deleting the reference
"International Plumbing Code" and replacing it with the reference "Uniform

Plumbing Code as adopted by 8 AAC 63.010. as amended as of November 1 L 2000
and as amended from time to time";
(17) Chapter 11, Subsection 1101.5 ofthe I.MC, is revised by deleting the references
"International Fuel Gas Code" and replacing them with "Uniform Plumbing Code
as adopted by 8 AAC 63.010. as amcnded as ofNovcmbcr 1 L 2000 and as amended
from time to time";
(18) Chapter 11, Subsections 1201.1, 1206.2 and 1206.3 of the I.MC, are revised by
deleting the references "International Plumbing Code and replacing them with
"UnifoIDl Plumbing Code as adopted by 8 AAC 63.010, as amended as of November
11. 2000 and as amended from time to time";
(19) Chapter 12, Subsection 1204.1, first sentence oftheI.MC, is revised by deleting the
words "shall conform to the requirements ofthe International Energy Conservation
Code";
(20) Chapter 12, Subsection 1204.2, first sentence ofthe I.M C, is revised by deleting the
words "to the thickness required by the International Energy Conservation Code ";
(21) Chapter 14 ofthe I.M C, is revised by deleting the body ofthe chapter and inserting
a new Section 1401 to read: "Gcneral. Solar energy equipment and aopliances must
be installed in compliance with the Uniform Solar Energy Code as adopted bv 8 AAC
63.010, as amended as of November 1 L 2000 and as amended from time to time";
(22) Chapter 15, of the I.MC, is revised by changing the referenced standards from the
publication date listed to the following edition, and these standards are adopted by
reference:
N.F.P.A. 13-1999 Installation of Sprinkler Systems;
N.F.P.A. 72-1999 National Fire Alarm Code
(Eff. 8/31/96, Register 139; am 3/27/99, Register 149; am~~ 2001, register

This ordinance shall take effect 10 days after enactment.
