CITY OF SEWARD, ALASKA
ORDINANCE 2003-03
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, TO (I) REPEAL ORDINANCE 2002-14, WHICH AMENDED
SEWARD CITY CODE SECTION 8.30.25(C)(1) BY INCREASING THE
ANNUAL BUSINESS LICENSE FEES FOR PERSONS PROVIDING
FISHING CHARTER SERVICES, AND (2) RESTATE AND REENACT
SEWARD CITY CODE SECTION 8.30.25(C)(1) AS IT EXISTED PRIOR TO
ENACTMENT OF ORDINANCE 2002-14
WHEREAS, the City of Seward enacted Ordinance 2002-14 on December 18, 2002; and
WHEREAS, Ordinance 2002-14 amended Seward City Code Section 8.30.025(C)(I)
revising annual business license fees by establishing a different fee amount for fishing charter boat
operators; and
WHEREAS, a referendum petition was issued by the City Clerk on December 31, 2002: and

WHEREAS, the referendum petition was returned and certified as sufficient with 133
verified signatures on January 17, 2003; and
WHEREAS, the petitioner filed within 30 days after passage thereby suspending the effect
of Ordinance 2002-14; and
WHEREAS, Seward City Code 4.15.050 provides that unless the City Council repeals the
affected ordinance, a special election is to be set within 75 days of a certified petition being
submitted to the City Council if the next regular election does not occur within 75 days of the
certification of a sufficient petition; and
WHEREAS, City Council Resolution 2003-15 to set a special election on this matter failed,
and the City Council desires to repeal Ordinance 2002-14 and restate and reenact Seward City Code
Section 8.30.25(C)(1) in accordance with its original language.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. City of Seward, Alaska, non-codified Ordinance 2002-14 relating to changes in
business license fees, the effect of which was suspended by the filing of a sufficient referendary
petition, is hereby repealed, including the amended language to Seward City Code Section
8.30.25(C)(1) contained therein (8trikecmt = delete):

Section 2. Seward City Code Section 8.30.025(C)(1), which would have been amended if
Ordinance 2002-14 had not been suspended, is hereby restated and, to the extent deemed necessary,
reenacted to read as follows:
"1. an annual, non-refundable fee of$30.00 per license, provided that the fee per license for
an application submitted after the due date shall be $60.00;"
Section 3. The restatement and re-enactment the Code provision as stated in Section 2 above
is effective as of the effective date of Ordinance 2002-14 prior to its suspension.

Section 4. This Ordinance 2003-03 shall take effect ten days following its enactment.
