RESOLUTION 2007-117
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH
MICHAEL L FOSTER AND ASSOCIATES FOR AN AMOUNT NOT-TO-EXCEED
$142,572 FOR THE PURPOSE OF CONDUCTING A WATER SOURCE STUDY
WHEREAS, the City Council passed Resolution 2004-13, which authorized the City
Manager to enter into a 70/30 matching grant agreement with the Alaska Department of
Environmental Conservation to complete an assessment of the public water system; and
WHEREAS, the City's portion of the matching grant was previously appropriated by the
City Council in the amount of $42,772 with the remaining $99,800 paid by the State of Alaska
Department of Environmental Conservation; and
WHEREAS, the use of competitive sealed proposals per City Code (6.10.315.) was used to
determine the most suitable engineering firm for the project; and
WHEREAS, the engineering firm of Michael L Foster and Associates has been selected to
perform the Water Source Study project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The City Manager is hereby authorized to execute a contract in substantial form as
presented at this meeting with Michael L Foster and Associates for the Water Source Study project,
in an amount not-to-exceed $142,572, for the purpose of completing the water source study project.
Section 2. Funds in the amount of $142,572 are hereby appropriated from State grant
revenues account no. 710-7100-4680-0200 in the amount of $99,800, and from previously
appropriated reserves from account no. 710-3050 in the amount of $42,772, for a total amount of
$142,572 to contracted services account #710-7100-5390.
Section 3. This resolution will take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13`" day of
November, 2007.

Agenda Item: Water Source Study Grant Contract
BACKGROUND & JUSTIFICATION:
In February of 2004, the Seward City Council passed Resolution 2004-13, which authorized the City
Manager to enter into a grant agreement with the Alaska Department of Environmental
Conservation. The purpose of the ADEC Grant (76912) was to complete an assessment of the water
system, identify needed modifications that are necessary to comply with State and Federal Drinking
Water Regulations and develop an implementation plan for water system capital projects.
The grant was a 70/30 Matching Grant. The State portion was $99,800, with a City match of
$42,772, making the grant total $142,572. The City Council previously appropriated the amount
necessary to match the State grant.
The staff carefully crafted a scope of work and advertised a Request for Proposals. The City
received proposals from four reputable engineering companies, CRW Engineering Group, LLC,
Michael L. Foster & Associates, Inc., GV Jones & Associates, Inc., and HDR Alaska Inc. After
considerable scrutiny and deliberation, the selection committee agreed that, Michael L. Foster &
Associates, Inc. offered the best proposal.
INTENT:
To award Michael L. Foster & Associates, Inc. the contract to perform the Water Source Study
(ADEC Grant 76912).
CONSISTENCY CHECKLIST:
Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive
Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
