WHEREAS, the City of Seward hoc applied for a Conditional lac Fcrmit (CUP) Gom
the Seward Planning uidLuning Commission to construct and manage the operation of the
community Long Term Care Facility (LTCF) on, '1"goer ll, 5cward Lung Term Care Facility
Subdivision. U.S.S. 1864, (Preliminary Plat); and
Wf1EREAS, at the September 4, ?007 Planning and Loiwig meeting the Coaunission
supported raid reconuncndcd Zoning and Land Use Map amendments to change Tract [), Seward
Long Term Care Facility Subdivision, USS 1864, (Preliminary Plat) Isom Single gamily
Residential (K1) to Institutional (INS); and
WIIEREAS, on November 26, 2007 Seward City Council appruveJ Ordinance 2007-
007, amending the. Land Use Map and the Rewning of Tract D, Seward i.ong Temi Care Facility
Subdivision, USS IR64, (Preliminary Plat) from Single Family Residential (Rl) to Institutional
(1NS); and
WHEREAS, according to the Seward City Codc, Land Uses Allowed "Fable 15.10?25,
facilities such as the planned LTCF development are allowed in the institutional7.oning llistrict
as a conditionally permitted use; and
WHEREAS, although the Greenhouse Facility (I lousing nursing, retirement,
wnvalescent home) requires institutional coned property, the philosophy and housing facilities
are residential in naturo; artd
WHEREAS, the intent is to provide a true residential neighlxirhood by clustering the
housing units and also providins laudscapc bull'ers w the adjacent residential and institutional
wuing districts; and

WHEREAS, this facility will he comprised of four (4) single story ten (lU) resident rJ
homes and a single story `commons' building to provide support to the homes with the
possibility of adding two (2) additional homes in the future; and
WH1r:REAS, nn January 9, 2W6, by Resolution 2006-04, Seward City Council endorsed
Seward's LTCP as an ollicial Green Housed pmjec;t; un June 2S, 2007 by Resolution 2UU7-(iU
Council approves the acquisition of Tract D, USS 1864 Long Term Care Facility preliminary
n:plat, and nn July 9, 2007 by Rcsohrtion 2007-63 Council approved additional funding fur the
site re-design by Architects Alaska of the LTCF located nn the new site localiun of'I'ract D; and
WIfEREAS, Nuvcntbe;r 13, 2007 the Planning and Zoning Commission and Architects
Alaska he1J a public work session to review and discuss the LTCP site plea and Conditional Use
Ycnnit application; and
WHEREAS, as required by Title 15 of Seward City Cude, public notice and public
hearing procedures for gtantirtg a Conditional Use Permit, all pmperty owners within three
hundred (3UU) feet and in addition all local property owners who use the Forest Acres road
network were notified and the propcRy was posted with public notice sign; and
WH1h;RF.AS, having complied with the public notification process, nn December 4,
2007, the Seward Planning and "Coning Commission held the required public hearing un the
Conditional Usc Permit application.
1\O~v, '1'HF.RF.FORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. Acwrding to SCC 15.10.320.D., the Cununission shall establish a lording that the
use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose ojthu chapter (the Seward Zoning Code) and
thr purpncec ojthe zoning district.
Finding: 't'his finding has been met. The property is currently zoned lnstimtional.
't'he institutional Zoning district provides an area for public and private health care uses
(SCC (5.05.025. (b) (11). (berating a long-term care facility is consistent with the
planned uses in the Institutional Zoning Disirici.
R. The value ojodjoining property will not !x significantly impaired
Finding: This lmding shall be met. Tract D, USS 1864 (Preliminary Replat) is a
large an approximately 8 acre parcel located to the south of the Forest Acres residential
subdivision. Tract D is adjoined to the South and Gast by the large approximately 51.8
acre parcel owned by the Kenai Peninsula Schuul Uistrict. This parcel is zoned
lrrstitutioiu+l and currently contains the Seward public schools. 'Ihe properties adjoining ,..rF

`. to the Aiorth and West are large, undeveloped privately owned parcels. "These parcels an
curreutly coning Single Family Residential. The planned facilities are residential in
nature. consisting of four (4) single story teu (l0) resident hontcs and a single 3tury
commons building. lltere is no indication that the proposed facility would negatively
impair the value of adjnitting property.

Finding: This findutg has been met. 1'hc rcla:ation of the L1 CF is in harmony with
the Seward 2U2U Comprehensive flan (approved by Cuwtcil. 2005) and 5tralegic Plan
(i!)99) in that both piano encourage growth and relocation of the t'f CF and heahb crre
needs of the community.

There. is no reason to believe that the LTCP would increase crime in the neighLwrhuod:
the campus shall be trash flee with well-groomed and mainUtined grounds, and anise
pollution should be non-existent. Screening through landscaping is planned to cuntroi
visual access to the elementary school located to the Fast. 'Traffic impact in the
surrounding neighhorhnod ttas been studied but unknown at this time. 'I'hctr is more than

be used on the premises.

the Cununission as a supporting doctunent for this Conditional Usc Permit shall
be approved by sniff or the Commission prior to implementaUOn.
?. Operation shall be consistent with 3.9.2.3 of the 2020 Comprehensive Plan
preserving the quiet of residential ucighborhuuds requiring soundprooling of
generators, air yuality control writs and other sources of noise in cuttttnercial or
institutional zones adjat:ent ro residential zones.
3. Modification to the final approval of this conditional use Permit tttay, upon
application by the pcrntitee, be modified by the Platming and Zoning
Commission:
A When changed conditions cattle the conditional use to no longer conform to
the sutndards Ior its approval.
B. To implemutt a different development plan conforming to the standards for its
approval.
C. 't'he modification plan shall be subject W a public hearing and a filinK lcc set
by City Council Resolution. "~
Section 2. The Planning and Zoning Commission 1'mds that the proposed use, subject to the
above conditions, satisfies the criteria for granting a Conditional lJse Permit provided tlx:
conditions listed on Section 1, Subsecaiun F are met by the applicant, and atrthorius the
administration to issue a Conditional Ilse Permit to tltc City of Seward to allow the construction
and manage the operation oC the Deward LTCF' on Tract D, USti I R(rl. Lunk Term Care Rcplat
(preliminary plat).
The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paratnotmt in maintaining the intent of Seward City Curie Section 15.10.320,
Conditional Ilse Petmils, and atnhuri~es the administration to issue a Conditional Use Permit.
Additionally, the adtinistration shall periodically confirm the use conforms to the standards of
ire approval.
Section 4. This rtaolution shall take effect 10 days following its adoption.
